LCWLA on universal credit who’s entitled?
so when speaking to someone in a similar situation as myself they told me i could be entitled? Yet when looking into it because i am my sons carer and get carers allowance it seems like im not entitled can anyone advise what is right and should i ask about this?

Hi,
It is possible to claim UC with LCWRA at the same time as Carers Allowance. However, the Carers Allowance gets deducted £ for £ from UC.
There may some confusion around Carers Element of UC, which you cannot claim at the same time as LCWRA.

aw ok so i cant claim LCWRA on UC then because i claim carers allowance? My partner and i have a joint claim and i do see the carers allowance and my partners earnings deducted in the statement?

You can claim LCWRA with Carers Allowance. But you can't claim LCWRA with Carers Element of UC.
If you are currently getting the Carers Element, that would be replaced by the LCWRA element.
If your partner currently claims LCWRA, then you cannot both claim LCWRA on a joint claim.

Hello @ksjm04. If you meet the criteria for LCWRA, you can claim this and Carer's Allowance, but you would no longer receive the carer element of UC. This be because the same person cannot receive the carer element of UC and LCWRA, they will only pay the higher rate which is LCWRA. Carer's Allowance will continue to be deducted from your award.

oh i i understand thank you so would i be better off claiming lcw then? And no my partner works full time

thank you it seems id be about £200 better off if i gave up carers element and tried for LCW then if i tried snd failed would they still just keep the carers element i receive high daily living pip

You don't need to give up carers element to put in for a WCA, you can continue to claim the carer element and if after a WCA they determine you are eligible for LCWRA they will then remove your carer element and add LCWRA instead.

If you were awarded LCWRA it would increase your overall award and income @ksjm04.
Please be aware that just because someone is in a similar situation to you, does not mean you will qualify for the same benefits as them. Have you looked at the LCWRA descriptors at all?

i had looked at them yes and i think i may score enough points based on my disabilities

Are UC aware of your disabilities? If not, you would need to report that as a change and also provide a fit note from your GP to start the process @ksjm04.

yes they are aware as my partner gets carers element for me on our statement. I thought the gp would only provide a fit note for me if i needed it to have time off work and i have to give up my full time job 4 years ago or so

Fit Notes can be provided for various circumstances, DWP do require them to carry out the WCA process.
The LCWRA amount is being cut from next month by quite a bit, so it would be best to start the process off as soon as possible.
