HI TO ALL, ABOUT 2 WEEKS I MADE A NEW CLAIM FOR ESA OVER THE FONE AND THEN GOT SICKNOTE OF MY DR TOOK IT IN JOBCNTRE AND THEY SCANNED IT TO ESA DEPT, THEN LAST WK THE BOSS OF THE ESA FONED ME ME UP ASK'D ME QUESTIONS AND THEN FONED ME BAK UP AND SAID "I'M SORRY BUT U CARN'T GO BAK ON ESA" AS IT SAYS THE SAME ON NEW NEW SICKNOTE AS WAT IT DID ON OLD SICKNOTES YRS AGO WEN I WAS ON ESA. SO WAT DO I DO NOW? I NOW WENT BAK ON JSA FOR THE TIME BEEN. LEE HALL

Hello Lee,
Unfortunately if you previously did not satisfy the Work capability assessment of ESA that is ESA found that you were able to work then when you reclaim you have to persuade ESA that you have a new health condition or your condition has significantly worsened. Is it correct that your health conditions are exactly the same?
You can challenge the ESA decision. That is you can request a mandatory reconsideration within 1 month of the date of the decision letter. You will need to explain for example that you have a new condition, what this is, and why it was not on the Fit Note or why your condition has significantly worsened pointing to (for example) an increase in medication or referral to a hospital specialist.
