Zero points!!?? Seriously?!!

Hi all, 

Just got my decision (first time claim) and as probably expected, I scored 0 points for everything and the report was full of lies like most on here...Why do they keep doing this to us. I have had a stroke and certainly matched up enough descriptors to allow for enhanced on both, but 0?!! I cant walk 50M without stopping - report said I can do 200m without issue (how exactly do they know that??), I can make budget decisions lol...yea right!!, I can prepare a meal....I nearly burnt the house down as the stroke has affected my memory so badly, that I forgot I had the gas on with food in the pan.....I could go on and on!! its a disgrace and this Government have a hell of a lot to answer for putting the likes of Capita and Atos in charge of our lives....So, now to start the MR process and probably fail that too...then have to wait a year to have a tribunal....pathetic joke of a system!!! sorry for the rant...more than a little upset and anxious now!!

    Just to add, if anyone has any advice on the best things to put on the MR form, it would be appreciated. I know most of these arent successful, but any help is great....Oh and sorry this came out 3 times...not sure how to delete the other posts

    Hello loydyd, it the way the system goes they won’t, hope we, you me will accept the acessment result and not appeal or take the matter further. It’s not the DWP fault but the acessment companies who are employing poor quality staff to take the acessments who fail to read and understand the evidence and information presented, given to them at each and every acessmet . It’s good to rant, moan let of steam it clears the air, but you will still need to put in for a MR by phone and a written request with in the 30 day deadline giving several examples of how your conditions affect you in relation to each of the PIP descriptors.

    There's no need to ring to request it. If you do this then they may not wait for the letter/evidence as i've heard this happen before.

    When requesting the MR you need to put what you disagree with and where you think you should have scored those points and your reasons why. Adding 2-3 examples of what happened the last time you attempted that activity for each descriptor that applies to you.
    I would appreciate it if members wouldn't tag me please. I have all notifcations turned off and wouldn't want a member thinking i'm being rude by not replying.
    If i see a question that i know the answer to i will try my best to help.

    sorry for the silly questions, do I put that in section 4? Part 4: Why you disagree with the decision and just list them all out? I disagree with so much of the decision, I am worried i will run out of room

    I assume so yes, i've never seen a MR form. If i was going to request the MR i'd prefer to write my own letter to be honest. If you run out of space the use separate sheets of paper but make sure you add your name and NI number to everything.

    Try not to concentrate on any lies that may have been told in the report. DWP or the Tribunal won't be interested in any lies told. Once the MR request is done then you can make a separate complaint to the assessment providers about the report, if you want.

    We have been for an assesment recently and was asked "how long can you stand" instead or how far can you walk, the reply was around 5 mins with my walking frame, which turned into mobility being removed completely, DWP refused to take MR request by phone, was told to send it in.

    Yea they framed it the same way for me...I said about 1-2 mins, but as with these kinds of questions, that could mean I could walk the length of a football pitch (if I was Ussain Bolt), but I'm not....and I cant...The system really is broken...Watching that Amber Rudd(y) useless MP last night going on about how she doesn't want her department to be a source of panic or anxiety for a section of society that already suffers....good job with that love!! Might have more to add to my list as the GP now thinks i have hemochromatosis  too...which adds to the dizziness and blurred vision and severe fatigue...oh the joys...Sadly due to the NHS being clogged up, I cant see the GP (after going for bloods) until the end of march....too late for the MR

    It is a bit like barking at the moon, don't worry about what you put in the MR, they already have your medical info. All you can say at this stage is, you disagree with the decision for those reasons.

    I would look at the descriptors and then would put an example, the cooking a meal is a good one. Put down what had happened when you did make a meal like you have said above you nearly burnt the house down, so you can't do this safely. I have epilepsy and I know that having a stroke is entirely different however have a look at this link I am sending you it really breaks down the descriptors and explains things have a look and think of what having a stroke and how it has affected you in carrying out these activities.

    When you request your MR, do so in writing and state that you have further evidence to send and ask that they wait for this before carrying out the MR

    I have completed my MR and will be sending it off today. I have mentioned new evidence but cannot show it until after my appointment on the 30th, when I will submit it.....I gave examples of why I feel the decision on the particular descriptors are wrong and gave examples of why the assessor was wrong in his assumption. I also corrected that he said I was alone (I wasn't) and that I was given an exam (I wasn't). I also corrected him that I was not anxious and seemed stable (being close to tears and clearly very stressed)...I did try to focus on the descriptors and not on the mistakes he made...but some of them go hand in hand and some of them were so wrong and needed to be corrected...Fingers crossed, but I am not going to hold my breath for a miraculous overturn at this stage (Would be nice though eh)?

    I don't think new evidence is going to help you at this stage, they look at how your health was when they assessed you.

    Sorry but this is not true. They will not consider a new or worstend condition, they will take new evidence that is relevant to the condition at the time of assessment

    Thanks CR, so as long as the new evidence relates to the conditions you have, then it is admissible.

    Yes. As we all know it is not always possible to access evidence from GP's and specialists in the time frame given by the DWP. So as long as the evidence was relevant at the time of assessment it will be admissible

    I am sorry the link didnt work. If you put into google epilepsy society then click on their link, which is https://www.epilepsysociety.org.uk
    Then in the search bar put PIP criteria and press enter. Then if you scroll down to the bottom of the page it will say PIP assessment criteria fact sheet April 2017 down load. You should be able to download the pdf doc.  

    When I did my MR appeal I didn't know where to start and there was plenty of tears and frustration. I just started by making notes and I looked at the PIP criteria sheet this helped me the most. 
    I am waiting for a tribunal date as most MR's do not change a thing. The downside to that is waiting along time for a date as there's big backlogs all over England.
