Pip assessor Lies!!

Hello,
I’m really annoyed, I had my pip assessment on the 3rd June, I’ve just today received my copy of it (18th) and the whole thing is lies!
He states that I don’t have depression when I’m on 75mgs of amitriptyline, he said I’m on sleeping tablets when I’m not. He stated that I was completely fine, when I was in tears the whole way through because I just hate and don’t want to be here! (only someone with or have had depression would understand this) I’m in pain every minute of the day due to my Lupus SLE, hyper mobility disorder, Antiphospholipid syndrome and osteoporosis. He stated that I told him that I’ve recently learnt to drive when I passed my test 11 years ago (I can’t even drive anymore as my knees gone) he also stated that I drove an automatic when I never have they were always Manuals!
I have terrible hair loss and memory loss due to my Lupus SLE and he claims memory’s fine and hairs fine when anyone who knows about lupus knows that you get hair loss and I have extreme fatigue! Just the whole lot of it is lies!
I have slipped discs in my back which is due to being too bendy with my hyper mobility. Yet he said that I did his exercises when I told him sorry I can’t as my discs will slip out and he said I did them all!!!
I’m so annoyed I feel like just giving up there’s no point when you feel like you have to get up every day to fight everything  just to get through another day to get kicked back down by a total Liar!!  Don’t trust them no matter how nice they seem that’s the second time I’ve read nothing but lies!!

I didn't read mine. I should - but I can't. Just remember you are you and the person that treats you badly, paid to fail you is not you. That's just someone willing to twist events. I found confidence from my bad experience that those who matter most are not one of them. If you can go on or find someone to attend with you - bear with it.

    Hi @LupusSLEsuffer and welcome

Unfortunately this is a familiar tale on the forums.
I am sure you are aware that PIP is not awarded for condition, illness or diagnosis but it is about your functionality and ability to do some everyday tasks.

Once you have the decision letter the next step is to request an MR in writing. You should give 2-3 examples of what happens when you attempt each of the relevant descriptors. and send any relevant evidence to support your claim.
Be all you can be, make  every day count. Namaste

    Hi,

As well as the good advice given by CR above then when writing the MR request you need to avoid mentioning any lies that may have been told in the report. DWP and Tribunal won't be interested in any of those. They will only want to know where you think you should have scored those points and your reasons why.

I would appreciate it if members wouldn't tag me please. I have all notifcations turned off and wouldn't want a member thinking i'm being rude by not replying.
If i see a question that i know the answer to i will try my best to help.

Hi @LupusSLEsuffer and welcome to the community.
Your assessment report unfortunately sounds very similar to many others. However, we’re here to support you through the appeal process and the aftermath as well.
If you feel like your mental health is suffering, it might be worth taking a look at some of MIND’s resources. If you urgently need to talk to someone about it, please get in touch with Samaritans on 116 123.

Please let us know if there’s anything we can do to help and know that we’re always here to support you.

Thanks for your advice. Everything in the report is just basically bull! What’s the point in going there being put through absolute hell to receive nothing but false statements. I just don’t know what to do, why do they write completely false things I just don’t understand it or why they would do this ;(

I feel your pain, been there had the same and its not getting any better, We had plain lies put down when my partner had hers assessment, was given a link for Welfare rights advisor, only it wasn't I ended up with a CAB advisor, ringing number after number I got an appointment only to find it was the CAB (different location) Mr jobs worth was 15mins late, ok so I was there and had time to kill, pulled up the PIP and MR site 3 times going over and over, long story short, we had been through the system before so knew what to, knowing how devious the DWP/Assessment Services are I requested to see a Welfare rights advisor, "he's retired now" can I see someone else then "no" We only 1 person with any legal skills and she is leaving, after some time trying to find out why he took a call which should have been for welfare rights, he went over the leaflet for the third time telling me "I need to address each descriptor and how if affects my partner"

Pulls out 8 pages listing each descriptor and where my partner cannot do as the descriptor explains, and showing examples of how it effects her, "that's too much you don't need all that keep it short"  I asked if they could recommend a good solicitor who could address some legal points and help with preparing the paperwork "There's no solicitor that knows anything like I do about benefits"

There are at least 2 major point where they did not do the assessment as the DWP guidelines dictate, we have a new Physiotherapist report listing walking, balance, range of movements and cognitive ability, I was hoping this would be helpful to send when putting in the Tribunal appeal, Mr Job's Worth said no paperwork over 1 month old was any good to send as it was out of date and worthless.

We left, I am beginning to calm down now and can write this, my partner is so upset she wont leave the room. In our case it was an ex-nurse, who set-up as Sports Physio and failed, her company closed, but she is still registered as a nurse, but nothing on her registration for years, her assessment over-ruled a Consultant Neurologist, Audiologist Consultant, and Vestibular Rehabilitation Specialist, who have worked with my partner for 3 1/2 years.

We now face going to London to see another Consultant but as of yet they cannot repair the nerves damaged during her operation, I short F2F has left my partner suffering from anxiety and severe depression and I cannot yet get her to the doctor.

I do know how you feel, its about time we had a way to correct the lies, plain and simple lies used to remove benefits from the very people who need them,
