NEWBIE... What should I do when I receive my paperwork in regards to commencing with an MR please?

Hi guys - newbie here
hoping for some advise on MR
So basically I applied for pip on the 30th of May got my face to face assessment on the 1st of August, and thought that because I had done my research, spoken to the citizens advice etc and communicated honestly about my health problems and provided proof and letters from my GP and partner explaining how my illness effects me and my family etc that I would actually be ok because my way of thinking was if I have evidence of my illness and diagnosis from doctors and specialists then how can anyone who is not qualified at that level disagree with the hard proof??
well I got a text on monday saying " I have been awarded pip and the decision letter would follow within 2 weeks"
I then received a back dated payment this morning and cried in disbelief, disappointment and frustration.
I called pip earlier and asked them to explain what I had been awarded which I was told standard rate allowance for my Daily living and nothing at all for my mobility?? she then went on to tell me that the assessors report that I had requested along with my decision letter is in the post and when I receive these I can request a MR after that.
I thought I would qualify for enhanced for both segments to be honest or at the very least enhanced on 1 and standard for the other at the veryyy least, so to find this out is just devastating after waiting and waiting and putting my faith in people to do the right thing, could anyone advise me on what to do when I receive my paperwork in regards to commencing with an MR please? - their experiences, time frames etc.
I am very intrigued at this point to find out whether its the assessor that has lied on my report or if its the person who made the decision after reading my medical evidence and assessors report who has gone off track and made this awful judgement? when I went for my assessment and was asked what I do for work , I explained that I was cabin crew for most of my working life but due to ill health I had to stop a couple of years ago and from then have worked for the Ministry of justice in the Crown Court along side Judges and Barristers and that it was actually a Judge that sat me down and told what pip was and that I needed to apply for it - his approach strangely seemed to change after that.
Im so anxious and stressed knowing I have to go through more of the pip nightmare to challenge the unbelievable award that I was given,
all advise is so appreciated at this point guys,
I will update again once I have received my letter and report, although after reading hundreds of other peoples experiences of having unfair inaccurate reports written about them I am honestly dreading having to learn where things have gone wrong.
xoxo

PIP isn't awarded based on any diagnosis so the assessor and decision maker doesn't need to have any knowledge of any conditions. What matters is how your conditions affect you against the 12 PIP activities. It's also not about how your family are affected, what they consider is how you are affected. It does help to have some knowledge of the descriptors and what they mean because it's very easy to overscore or even underscore yourself. You may want to sit down and have a read of this. https://www.gov.uk/government/publications/personal-independence-payment-assessment-guide-for-assessment-providers/pip-assessment-guide-part-2-the-assessment-criteria#daily-living-activities It's long but is worth a read.If you're not able to do that then i'd advise speaking to an advice agency near you, this way you can explain in detail exactly how your conditions affect you and they will tell you if scoring more points is possible.Start here. https://advicelocal.uk/If after all that you're still going to request the Mandatory Reconsideration (MR then you need to put that in writing stating where and why you think you should have scored those points.Include a couple of real world incidents of exactly what happened the last time you attempted each activity that applies to you. Adding detailed information such as where you were, what exacetly happened, did anyone see it and what the consequences were. You should aim for at least half an A4 side of paper per descriptor that applies. When you receive the report, you need to put that to one side and forget about it because that it's going to help you score more points for a higher award.Medical evidence is only useful if it states exactly how your conditions affect you and most doesn't.The most likely outcome of the MR will be the decision remains the same because only 27% of them change. If this happens then you can request the Tribunal. Decision times for MR's is between 2-12 weeks, sometimes longer.

I was advised by citizens advise to have my partner write a letter to describe how they see my illness affecting me and what kind of impact it has had on the family? and also what help I need from them as a direct result from my illness - does that not sound right coinciding with your own experience with pip?
I also provided the assessor with a few real life examples of times when I have attempted to do certain activities and what the outcome was, so its difficult to understand how the decision has got to where it has, but I guess I will know more when I get my paperwork through and then I will go through the recording of my assessment against the report and see where there is any inaccuracies or mistakes and build a case from there.0 -
Yes you can ask family for a supporting letter. I've never personally done that because only i really know how my conditions affect me but some find it helpful.Trollydoll01 said:then I will go through the recording of my assessment against the report and see where there is any inaccuracies or mistakes and build a case from there.
That isn't going to get you a PIP award. In fact it could damage your case, if it gets to Tribunal and it most likely will. The best advice anyone can give is to move on from the assessment because that's in the past and concentrate on where and why you think you should have scored those points. The recording of the assessment can't be used unless it's professionally transcribed. DWP or HMCTS do not have the equipment needed to listen to it.Please have a read of the first link i posted.2 -
I will have a read - thanks for sharing, I work for the HMCTS so that side of things Im confident with thankfully, but this whole process is just mammath, I will be glad when its sorted 😫

Thankyou,
Its such a difficult thing to navigate through and I truly feel there is underhanded goings on at play with this whole dwp decision making process?? 🥺 why not let the real medical professionals diagnosis and expert opinions be the decider and not these people? I actually cant wrap my head around how its legal to be honest, the dwp employees are reading mountains of genuine medical evidence proving a persons situation and yet somehow they have the power to over ride it all? Its just baffling? And definitely making my anxiety worse, they said that my decision letter&report was both posted on the 20th yet still I dont have it which is delaying me getting on with my MR 😮💨 its soul destroying.0 -

They don't know anymore about how a claimants conditions affect them that anyone else does. None of those benefits are awarded based on any diagnosis. It's not unusual for letters from DWP to take a couple of weeks under normal times. Take the bank holiday and the Royal Mail strike into consideration too which will add to the delay with post. You don't need to the decision letter to request the MR anyway. Work capability assessment decisions are very basic and it wouldn't go into any details of anything other than to say what the decision was.You can just carry on with the MR request by putting in writing.0 -
But I am told I need to read through the assesors report and the decision makers letter to be able to pin point with what I dont agree with abd explain why etc? Do I do need them before doing the MR unfortunately- right?0
-
So I do need my paperwork before starting my MR that meant to of read *0

Right ok, i thought this was regarding ESA because you've posted in the ESA section of the forum. Having read your first comment again i see it's a PIP claim. Therefore, you will need to wait for the decision letter to see where you scored those points. Sorry for the confusion.@Alex_scope @Tori_Scope @Ross_Scope could you please move this thread to the PIP/DLA section, that way it will save a some confusion. Thanks.1
-
I've moved it over, thanks Poppy. @Trollydoll01 it can be a very wearing and difficult process, but the community is hear to support you
You might like to search for a professional adviser near you, you can use Advice Local, generally it's best to know exactly how you've been scored once you have the decision letter.
That way you know exactly where to highlight as somewhere you think you should have scored more. Does that make sense?0 -
@Alex_Scope thank you.

Thanks @Alex_Scope its definitely a very draining thing to go through isnt it, I am still waiting for my decision letter and the assesors report? Its been weeks now, Ive called dwp twice to ask for them because I want to do MR and been told twice they are being posted however still nothing? Its all getting me really down.
