Hi,

I won my pip tribunal on 29/09/2022. I was awarded full rate on care and mobility by being awarded an extra 20 points.

It took 16 months from start to finish but I just wanted to tell people that it is so worth not giving up.

I had my first appeal to the tribuneral put on hold as they wanted more information from the last 2 years which they gave me a letter to give to my doctors. This letter meant it wouldn't cost me anything to get my doctors to give them all my history of any contact with them. I didnt have to go to appeal and they made the decision without me having any form of contact with them.

What do you mean by you didn't have any form of contact with them?

I ask this because I am in the process of a Tribunal and DWP hasn't responded on 2 occasions and have been given there final warning to respond.

Sometimes the Tribunal will make a decision on paper alone, without the need to attend if the evidence is good enough.
However, paper based decisions in general have a very low success rate so i wouldn't advise you choose this option.

Mine was paper based only. The DWP had also made mistakes from my form application and the reconsideration.

The DM didn't want to know when they rang me regarding my MR!

At one point through the call I asked him to refer to the g.p or health care medical paperwork I had sent in or the contact of the medical people I had put down on the form and he said very bluntly that we never contact them!!
He soon went quiet when I said to him that YOU ask for medical references who the DWP can contact with regards to my son's health care!

I have put this down in my grieviences to the Tribunal because I am annoyed that he said this to me.

All he kept saying to me was, where is your proof I want letters, paperwork, I mean I told him to contact those very people I had put on the form and to look at everything I had sent in and he just abruptly told me to wait 10 day for the decision and that was that. I knew they had made there decision as soon as I answered the call.

I do feel that the Dwp discriminate and sometimes don't bother with MR's because mine was a total shambles the way he behaved and the way they have gone quiet!

Yes on the form they ask for details of professionals but they very rarely contact anyone for any evidence. Try not to get too carried away with what was said or not said and what they didn't do because none of that will get you a PIP award.

This for my 5 year old son's DLA Award.

What he said does matter because he used that to basically make his decision on my son's award. The MR paperwork states he made his decision based on my form that I filled in!

I do feel how DM's conduct there work and make decisions does matter. Oh I'm not getting carried away, trust me, I know how it works because I have been dealing with my eldest daughters dla claims since 2014.

Thank you poppy for the insight and help, I do appreciate your input. 😊

As you posted on a PIP thread then i assumed it was PIP. This is very different to PIP and for a childs DLA claim they do sometimes contact professionals, including the childs school.
