edited December 2024 in Universal Credit (UC)

I got a migration notice to go onto universal credit in September. I am on esa support group and my husband who had to do a joint claim is on carers allowance. We did the joint claim and did everything we were ask to do and that’s when I was instructed to put in fit notes and then I got sent a uc50 form which I had to fill in and send back by October. I thought that you automatically went on to uc and didn’t need to fill in forms or put the in fit notes I take it I was wrong.

As you were in the Support Group you will have been entitled to the LCWRA element from the start of your claim. Fit notes were not needed. The reason you were sent a UC50 form is because you provided the fit note.

What you should have done is ignore the fit note request and put a message onto your journal to tell them you were in the Support Group. They wouldn’t have known this until ESA sent your details across.

Does your UC include the LCWRA element?

my uc doesn’t include the LCWRA element. I have now been informed by my work coach that esa and uc are two different benefits and that I need to go through an assessment for both.

Something has gone wrong here. If you were in the Support Group for income related ESA before then you are entitled to LCWRA from the start of your UC claim. You should not have sent a fit note as that confuses the migration process.

If part of your ESA was contributions based then that will change to New Style ESA.

They are two different benefits and you do need to accept commitments for each individually. But the work capability assessment is the same for both so you do not need to have two assessments.

The work coaches don't understand how the system works. You can't rely on their advice.

It should include the LCWRA element. If it doesn't and you've received your first statement then you need to put a message onto your journal to tell them that it wasn't included and you were in the Support Group when you migrated across.

Going forward for others migrating to UC the system should now detect that you were in the Support Group, which should have been done a long time ago.
