LCWRA and ESA
Hi all. Firstly, thank you to those who have corresponded during previous discussions 😊
Secondly, I have some questions regarding my recently awarded LCWRA and my ESA.
Yesterday I received notification in my journal that have been awarded LCWRA.
- My precious entitlement for UC was £174 something *after taking into account my husband's arnings, money owed etc) which was subsequently wiped by my ESA award. With the new entitlement amount, do I get any UC as well as my ESA?
- Does ESA automatically move to the support group or do I have to notify them?
- How long does it usually take for ESA to catch up?
- Does LCWRA mean there will be a disability element of ESA?
- My next statement falls on Christmas eve, is there anyway of finding out what the new amount will be sooner?
Apologies for the long winded message. I've spent the best part of 30 years knowing exactly what I get with my wage each month and this is all still new to me. I now get the higher rate of PIP for both elements and I'm still adjusting to it all.

1/ If you didn’t previously have the work allowance this will now be included on your claim. It means some of the earnings received are disregarded before deductions apply.
If you claim help with the rent it will be £404/month, if you don’t it will be £673/month. For every £1 of earnings received over those amounts your UC reduces by 55p.
2/ Whether there’s any entitlement now will depend on your partners earnings.
3/ LCWRA for UC is £416.19/month and is paid from the 4th month after you provided your first fit note. When it’s paid from will depend on what date exactly you provided your first fit note and what date you usually receive your money each month.
4/ For ESA you will be placed into the support group and your money will increase to £138.20/week from the 14th week of your claim. The deduction for UC will also increase to £598.86/month.
5/ No, you will not be entitled to any disability premiums for ESA because they are not payable with New style ESA. They are only payable with Income Related ESA.

It's difficult to advise on this one without knowing how much the deductions are for your husbands earnings etc. If you can post a screenshot of the last statement that might help us.
We can say that the LCWRA element adds £416.19 to the overall UC total, before deductions.
New Style ESA will still be deducted from the UC in full if you are still entitled to that. You should be moved to the Support Group automatically but it may take a week or two. There are waiting periods for both LCWRA & Support Group so they may not be payable immediately if you've been waiting less than 4 months for the WCA. If that is the case, please let us know the date you supplied the first fit note.
There aren't any additional elements payable with New Style ESA, those were for Legacy ESA.
Statements aren't generated early, so you do have to wait for those. However it is possible to calculate the amount using a previous statement in most cases.

- I am not sure what having the work allowance means….. I had to give up work when I first made the claim and my husband's earnings were taken into account. I do not claim help with rent.
- I was entitled to £174 per month but it was short lived as my ESA wiped that out.
- My first fit note was dated 26th July and my one and only UC payment before I started getting ESA was the 28th of the month.
- So I don't have to notify anyone? Apologies if I have read this incorrectly, it doesn't matter what my new UC entitlement will be because my ESA of £138.20 per week will wipe it out….

Thank you so much. My first fit note was supplied on 26th July this year. I would love to send a statement but I've just been kicked off my account! Maybe because I tried to access it from both my phone and laptop. I guess the short question is what will get? My husband's earnings haven't changed and before I started getting ESA I was entitled to £174 per month UC

You’re welcome. The work allowance will apply to your partner because it applies to the claim, not the person. Please see my above explanation for details.
If the 26th July was the same date you report your health condition then your waiting period will be Aug/Sept, Sept/Oct, Oct/Nov… LCWRA starts from assessment period 22nd Nov to 21st Dec and first payment will be 28th Dec. If you reported your health condition on 22nd July then your first payment will be 28th Nov.
The work allowance will apply from assessment period 22nd July to 21st Aug so they may owe you some money from that.
For your ESA UC don’t always share information with them so I’d advise you to ring them to tell them.
Your ESA may not wipe out all of the UC entitlement now due to the work allowance but it does depend on your partner earnings and what your UC entitlement is before deductions.

Unfortunately we don't have enough information to calculate your new entitlement because of the added complication with earnings and work allowance in this case.
Sometimes the UC website crashes for a while. Hopefully it'll be back up later and isn't caused by anything you've done.

You said your husbands earnings haven’t changed but we don’t know how much earnings he receives or what elements are included with your UC.
We would need all of that information to be able to advise further. (I’m not asking you to provide this) Or you can use a benefits calculator. Don’t forget to tick the box where it asks if you have LCWRA.
You also mentioned claiming PIP daily living. Did your UC include carers element for your partner?

You are referring to carers allowance, which is a completely different benefit.
There’s no earnings threshold for carers element of UC. This will also increase your maximum UC entitlement by £198.31/month.

Gosh, I guess there are lots of elements that don't go hand in hand. I wasn't aware, thank you. Is that something they automatically work out?

Your husband will need to report being a carer to UC for them to include the carer element.

Your husband will need to report a change of circumstances. Then click caring for someone and report caring for you. This is assuming that no one else claims this or carers allowance for looking after you.
