Backdated LCWRA

Good Afternoon
I am Kevin I am hoping someone who understands about this can help me I have been on universal credit since April 2019 so 3.5 years I have provided a fit note from the very first day my work coach said they kept requesting an assessment for me and I only just recently had it so today I was told I am going to get LCWRA so will this be backdated because I have continued to provide sick note from the first day I know they not going to give me £14,000+ what is equivalent to how long but does anyone know the maximum backdated they give or am I newly rich financially

The LCWRA status should apply from the start of your claim and the LCWRA payment should start from the fourth month which would be the August 2019 payment.

If they owe you the money it will be paid to you. You only had your assessment today, are you saying you've received the decision on that already? Or was it the HCP that told you this?

Hey congratulations on sorting you universal credit out, I too got mine this week however my back payment seems wrong as I handed my 1st note in April-2021
so it’s Apr/May, Jun/July, Aug/Sept
October =1
November =2
December= 3
January=4
But I only received £756
so I’m a little confused like yourself on that because it doesn’t seem correct.
So Your not alone in your confusion I struggle to understand how they work it out too but good luck I hope you get a newly rich surprise really soon 😊🙏

Before they can pay what is owed to you they first need to recalculate your past statements. This will then tell them what you should have been paid against what you have been paid. You will then receive the difference between the 2. Once this is done you'll receive a letter on your journal telling you how much they owe and it will then be paid into your bank.

Once your statements are recalculated they will replace your existing ones so if you want to keep the current ones you should take screenshots.

There's a full 3 month assessment period waiting time and the extra money is then paid from the 4th month after you reported your health condition, providing you sent a fit note within 7 days of that and continued to send them without any gaps until a decision was made on the WCA.

Any gaps can affect when the LCWRA element is paid from.

So what date did you report your health condition and did you send fit notes the whole time?

Also what date do your assessment periods cover or what date do you usually receive your money each month?

thank you for your help it’s really appreciated, I recall seeing you’d explained the above so tried to figure it out based on that but the letter Iv had in my portal has made me even more confused 🤦‍♂️

So I first notified them of my poor health and provided my 1st sick note dated 21.03.22
my actual payment date is the 19 th of each month and first arrived on the 19th of April 2021
However 😂 I am also a carer for my son who is disabled too and I get the £****.70 weekly allowance, but UC deduct that off my payments they said.

This is we’re in my letter explaining my new amounts I have become completely lost I will pop what is written in a moment to see if you can understand it.

This is what the work coach said below.

You have now been awarded the limited capability for work related  element (LCWRA) and this comes with an extra premium of £354.28 but as you now get this you no longer receive the caring element (CE) premium.

The carers allowance you receive for caring for your son is still taken into account.  

Your benefit will increase each month by £185.47 this is the difference between the LCWRA and the CE.

But my question Poppy was I thought I could no longer claim carers as you can’t do the two. So if that is the case then why are they only awarding me £185 and not the full amount?
or am I supposed to keep claiming carers too?
either way I actually don’t think I’ll be better off here after joining the LCWRA maybe I’m missing the boat but I’m so confused

In this comment you said your first fit note was in 2022 but in a previous comment you said it was 2021, can you confirm which year you actually sent it?

If your payments are 19th of each month then this means your assessment periods(AP) are 13th to 12th of each month. You sent your first fit note in AP March/April, which doesn't count because it's not a full AP.

Therefore your waiting period will be April/May, May/June, June/July.. LCWRA starts from AP July 13th to August 12 and first payment would be either 19th August 2021 or August 2022, depending on which year you sent your first fit note.

You are claiming carers allowance which is deducted in full from your UC entitlement. Before you were found to have LCWRA then your UC should have included the carers element, can you confirm that your UC included the carers element of £168.81/month?

You can't claim both the LCWRA element and the carers element at the same time so you will be paid the higher element, which is LCWRA. They will then owe you the difference between the carers element and LCWRA element, which is £185.47/month. Going forward you will receive the LCWRA element of £354.28/month extra.

You can continue to receive carers allowance but there's no financial gain because it's deducted in full from your UC anyway.

They gave me £6000+ saying they are paying from 2021 to be honest I am satisfied and I was expecting something like that I do have full proof on the universal credit account that I have provided fit for work notes since 2019 should I appeal it or just be happy with what I was given and carry on with life could you please give me a genuine answer

Don’t know know what you mean by a genuine answer.

If you reported in your health condition in 2019 and if you provided continuous Fit Notes then you should be entitled to extra money from the fourth month after you reported the health condition. It’s your decision whether or not to seek this or not.

I said genuine answer because I have been told that people say you are entitled to it but benefits only pay a certain amount that was why I said that but I will appeal it and explain I have my full proof which so do they because they have access to my account so we will see what they say

Was this the first work capability assessment you've had? or did you have one prior 2021 and were found fit for work?

The first one I had my work coach said they were requesting one but due to covid etc I never got a date but I have double checked and all through the lock down I had to provide sick notes and they continually got them from 2019 up to present
