Hello there @odonnell75 and welcome, thanks for posting :)

Just so that I understand fully, are you going to tribunal for an ESA decision, or a PIP one?

If we can help support you, please let us know, as tribunals can be very stressful. Does your daughter has a date for it?

Okay, thanks for explaining @odonnell75 that's helpful to know :)

I hope things go your way, and if you need help with anything while you wait to hear from the DWP, I've moved your posts over into our Universal Credit (UC) category.

Keep us updated when you hear more!

It makes no difference if DWP do not respond and the hearing will continue as normal. It's not unusual for them not to respond by the date given.

They really should be fined or something if they don't respond by the date set.  It's not on.

They Tribunal will extend the date. If they still don't respond nothing will happen and the hearing will continue as normal. DWP will most likely respond eventually.

That means that DWP are looking at all the evidence before responding. Sometimes they may make an offer at this stage but it's rare for them to do this.
