edited June 2023 in Universal Credit (UC)
Hello, last year I suffered an incident from which I still haven't recovered and need further surgeries. Me and my wife receive UC. Not long after the incident took place , I filed a form for PIP. UC approved the sick notes for 3 months, and then informed me that I have to go for an assessment in a month. Due to the heat last year, they cancelled the assessment and arranged a telephone meeting a month following that. I then received a letter , saying the assessment was LCW, I didn't know what that meant and I didn't appeal their decision. September I got a call from PiP, and a month later I received a letter saying they rejected me. After MR I sent the documents I had to the tribunal, and during this time , universal credit were tiring me out by looking for a job for me. March after a dispute I got sent for a new assessment and I received LCWRA incredibly quickly . A month ago the court awarded me with PIP with backdate from last year. The question is the following ; can I appeal the first assessment from UC for LCW, because on the phone they said something and it the end it turned out different . In other words, can I get them to give me LCWRA from the date that the PIP is from. I still don't get money for LCWRA, it's been 3 months and I'm waiting for the next month. In UC journal , we have pointless chats like in a dating group, waiting for answers for several days

i know PIP doesn't automatically give  LCWRA ...but they left me without any help for 16 months..

Thank you

If the decision on the first work capability assessment was more than 13 months ago then you are out of time to do anything about that now.

You can request the MR for that decision but please be aware that they will not take into consideration any worsening of condition. They will be looking to see if the decision was correct at the time it was made.

Thanks again for the reply. My condition has not changed since then. I just wasn't familiar with the procedures involved in these things and that's why I'm belatedly trying to fix things. I have made a request in my journal for the MR and I am waiting for some response from them. thanks
