Awarded LCWRA but was Sanctioned before that

Hello everyone,

Have just been awarded lcwra but before that I have missed some of my appointments and was sanctioned for 56 days. I Requested for a mandatory reconsideration and i am still awaiting decision on that. Now that they've awarded lcwra, will they recede that decision and pay me fully my UC including any backdated payments?

    I will attempt to explain this much more clearly. I Did send through my fitnote which state my current health challenges. I was expecting DWP to consider whether or not i understood whst was required of me and how the state of my mental health health affected my ability to meet the requirements. I also had a flare up of my Gout and was unable to walk or stand and it comes with excruciating pain. My mental health means if spend time with other people it could leave them feeling stressed out. So my disability made it difficult for me to attend my work related activity and that was an issue I raised with Seetec on the phone . So I do not believe I should be sanctions based on my disability.

    Hi Jonathan

    I am also a community member, I am not sure what happens, Poppy seems to have a lot of knowledge so she might answer.

    I am having a guess, I would think if they sanctioned you when you submitted a note, but missed appointments because of your health, that you might get the money back.

    Because of the lcwra, I they MIGHT say that you were not capable for work at the time they sanctioned you and so you should not have been required to attend appointments. I am just guessing, I am not sure.

    You could try contacting somewhere like the Citizen's Advice Bureau for help with contacting them to ask this or to request the money back for that time.

    What were your commitments prior to the LCWRA decision? I’m assuming you agreed to those commitments to get UC.As far as I know prior to LCWRA you would be in the all work group I would guess any decision made prior to LCWRA will stand unless the MR is in your favour,good luck I hope it turns out alright for you.

    If the sanction was made after you provided your first fit note and there were no gaps in the fit notes up until a decision was made then you will receive everything that's owed. This will include the money from when you were sanctioned.
