Do you mean you’ve requested the MR (Mandatory Reconsideration) for the DLA?

If so and she’s not currently receiving either mid/high rate care then whether you’re expected to look for work will depend on her age and your circumstances. You can’t claim carers element unless she’s claiming either mid/high rate care DLA.

she is 12, hardly attends school due to being highly dyslexic, yes I’ve requested a M R. I’m also caring for my 31 year old who is adhd asd and has seizures I don’t claim any care for as she is worried it will effect her dla. She works part time. It’s so overwhelming, I suffer with mental health just lost my job.

Do you have any mental health support in place @Jomich? I'm so sorry to hear you lost your job.

If the 31 year old is claiming either mid/high rate care DLA you can claim carers element for looking after them. It will not affect their DLA.

As you have health conditions yourself have you reported your health condition and provided a fit note? This will start the work capability assessment process off, unless you’ve already been through that.

I understand that having health conditions myself and a daughter with ASD, learning disability and social anxiety. However, sometimes you also have to think about yourself.

If you reported your health condition and provided fit notes once a decision is made if found to have LCWRA then you'll be entitled to extra money from the 4th month after you provided your first fit note. However, the same person can't receive both carers element and LCWRA element at the same time. In this situation, you would receive the higher element, which is LCWRA.
