We now have all the information we need to decide (pip)
Hi everyone,I’m new here iv been fighting for pip for almost 2 years,It’s been a constant battle and refusal,lots of lies,error in law and other issues.
Anyway iv had this letter after 2 years this letter was wrote on the same day as my tribunal that took place at home,the tribunal wasn’t completed ,they said it was some issues that took place with equipment.
So I get an email saying tribunal will be rescheduled but don’t know when but then I also get a letter from dwp saying we now have all the info.
I feel like this isn’t fair and I’m having to go through so much why confuse me,the next tribunal will be the third one I have on this one claim which has been nearly 2 year.
Whats going on,anyone had this ?

Seems rather odd that they sent that letter. The only way to find out what's going on is to ring PIP tomorrow when they open at 9am.

Hi @bobabubbles21, were you supposed to attend the tribunal via video or telephone? It seems awful that they didn't have the equipment ready for that if so. Was the first tribunal cancelled for a similar reason? The courts and tribunals service is heavily backlogged so it is taking a long time. Given you've been delayed twice I would try ringing up HMCTS to see if you can be prioritised for rescheduling given how long you've been waiting.

@poppy123456 i feel like everything is odd at this point, my first ever call I had when all I said was I’m not well enough to take this call they writ up a whole report of lies most as if I was there in person from what they wrote,I didn’t even speak apart from say I’m not well enough to talk,I phoned up to do a Mr and again they denied me, off it went to tribunal with help of a welfare organization that looked at all the descriptors,at court the judge asked me question irrelevant to my condition and the Dwp accused me of somthing that wasn’t true,I was drained and it ruined me for months the after affects,my organization said this is error of law,when I did a statment of reason they used the most ridiculous excuse not to award me,I knew I had a fight.i was directed to do a upper tribunal,I wrote a letter explaining what was wrongly asked ect.
My appeal was accepted for it to go to upper tribunal as they responded saying non of my evidence was refered to and many errors in law,it said I should of been awarded standard on both if my evidence was looked at,they even put a different panelist name of the form when that person wasn’t present.so lots of strange things going on.
Then I hired a welfare person and he looked at my case , he did my submission and he also noted down all the legal side of things,I had my tribunal and it got interrupted due to issues,they called back after 10 mins to say best to reschedule,what’s odd is the same day Dwp has wrote this letter to me.
I have a hearing regardless of what Dwp says and also with my case being taken to upper tribunal whatever decision the tribunal make can not be overturned.
Hopefully I find out soon.
This has been my experience and it’s been horrendous.

@jimm_Scope so my first tribunal was at the court and I was asked questions irrelevant to my condition and Dwp lied about somthing,
The professional helping me said its error of law,I did the statment of reason and the upper tribunal said no need you can have a new hearing , as mentioned to @poppy123456 they said an award of standard could of been given if they looked at evidence,I was ignored by a judge and that panelist,I was told they will not be allowed at my new hearing and my treatment will not be how they treated me.
2nd tribunal -
I had my tribunal I spoke and answered things for a good half hour but then there was interuptions of some issues ,got a call back to then be told best to continue another day as it wouldn’t be fair if we all can’t hear and yes my tribunal was at home as I just mentally go especially with my condition and how I was treated last time,
So then I got an email explaining my tribunal didn’t finish so I will get a third tribunal hearing .. my god !!! Imagine a 3rd hearing on the same case but weirdly the Dwp wrote a letter dated the same as when my tribunal took place saying we have all the information,whatever this might be I’m baffled , like I said either way I know by rights I still have a new hearing that will be booked but they said on the email they can’t give me a date yet and I have to wait, so why would Dwp now all of a sudden want to intervene is it because after speaking for half hour and information iv give along with the evidence that backs it up.
Its just a waiting game but il let you know the outcome.
I think it’s important to share individual cases and experiences so others have an idea.
You can only take a case to UPPER TRIBUNAL IF THE LAW MADE AN ERROR, not because you don’t agree with the decision just for people to know.
Not many people take it to upper tribunal but I know with how much iv suffered and the impact iv had I wasn’t giving up just yet and thanks to the professional help and support I got. X
