I don’t always receive clarification from UC so thought perhaps you could help. I recently was awarded LCWRA whilst undergoing cancer surgery etc

I have returned to work and although not fully fit I am hoping to be fitter in another month. I am wondering how they deal with the cessation of LCWRA. Do they apportion it to a daily rate for the calculation or if you feel your health has improved within an assessment period do they cancel it for the whole of that month. So if halfway through the assessment period am I still eligible for half of the months LCWRA?

    With LCWRA you have a work allowance.

    If your UC award includes Housing Element, you can earn £404 without your UC payment being affected. If no HE, the amount is £673.

    UC generally don't do pro rata changes, it's the circumstances on the last day of your Assessment period that count.

    LCWRA doesn’t just stop if you return to work. It continues for as long as you remain entitled to it. Remember, you do not need to be affected by your health conditions all of the time.

    just to clarify, kimmy87 you mentioned the apportionment. You would only get LCWRA if it was relevant to every day in the assessment period? They won’t calculate a daily rate if you were entitled for the first 20 days of the assessment period- they take it all as entitled or not and apply to that months assessment period?

    If the DWP decided you were not entitled to LCWRA element, then the change would apply to the beginning of the assessment period in which it was made.

    Example:

    Assessment period 24th November to 25th December.

    DWP decides you are no longer entitled to LCWRA 20th December.

    On the statement of 26th December LCWRA has been removed, and it is not paid with January payment for AP of 24th November - 25th December.

    This suggests to me that at the beginning of the assessment period, the lcwra was applicable but not at the end, I have a similar situation whereby i retire mid Dec with my final ac period is

    dec 4 to jan3 but have read online that uc only take into account what i will be on at the end of the period. so with my retirement starting on the 24th dec. will i loose it?
