Child element
Hi , I started my claim in 2021 where I added my 3 children. I was unaware of special circumstances regarding my 3rd child , 3 years layer I was made aware with the legal challenge which had been shown on the media, I have handed in an NCC1 form and they have added my 3rd child for child elemnt , but are refusing to backdate, it amounts to over £11,000.....a desicion maker had said I'm outwith the 13 month time limit ...there is NO time limit with the ncc1 form , any advice ? I have contacted my mp and they are going to advocate for me ...also reported to dwp complaints team as the amount if failings through phone and journal are terrible , agents are not allowed to question on this matter due to the sensitive nature , but they did in detail numerous times ..thanks x

One of the successful arguements I've come across for this situation is that, in the early stages of Universal Credit (UC) applications, they did not ask if 'special circumstances apply'. I can't recall the exact year when this question was added, but if you look back at the start of your UC claim and the details you submitted, it should show whether you were asked and what your response was.
