Will they backdate carers element?

I started caring for my son 8th July 2022 I was told I couldn't get carers allowance as I worked 16 hours but wasn't told about carers element until October just gone so I applied for the element but got refused the back dated money as they said I was out side the 13 month deadline, but if I wasn't told about the benefit how was I to know I was late for claiming the benefit, I have been refused backdated money by mandatory reconsideration so taking it to tribunal do I have a chance of winning

Hi,
It's not DWP's responsibility to tell you about every possible element of UC.
It's your responsibility to tell UC when any changes happen. That includes caring for another person.
The tribunal might allow the backdated money, but legally I don't believe they have to in this case.
