Disabitly elements , income support, transitional protection help please 🙏

Hello, I was awarded standard care on Pip from June 2024. After a mandatory reconsideration, DWP called me today to say they’re changing my rate to enhanced to run from June 2024, so eligible for a back payment.

During last year up until the 31/12 I was in receipt of income support. I migrated over to UC in January 25.

I was receiving disability element and severe disability element and thus my transitional protection to UC reflected this.

I’m wondering now if I would have been eligible for the enhanced disability element from June 24 - dec 24 and whether one: I would need to contact income support and two: if my transitional protection would go up. I know premiums are not carried over to UC per se but if I was eligible for enhanced care pip before I transitioned to Uc, surely that would need to be taken into account in regard to transitional protection thus also creating back payment from both income support and universal credit (to include the extra TP element?)


It’s all so very confusing - I hope someone can help.

    Yes I believe you should contact Income Support (if such a thing is still possible) to retrospectively apply for the EDP.

    If awarded UC should then make the necessary changes including backpay.

    You might want to consult a trained benefits advisor for assistance.

    Thank you very much , I called up Income Support today and they’ve put it to a decision maker. I think my main issue is how to put it to Universal credit , I know the enhanced element of income support is only an extra £20 a week or so but that £20 a week will be used to support me with my disabilities. With UC it might total approx £90 extra a month I think .

    Do you mean income support, or income based ESA?
