Hi,

I've had my Esa, and housing and council beneit stopped because they UC, said my second him is worthth £675.000 which It isn't. The home is jointly owned by my Husband. Who is 79 and very poorly. He receives a care package.hton

pwtd. I've been claiming all my the benefits sine 2014. I was diagnosed with terminal breast cancer in March 2015. I still have metastatic cancer which means it's still my body but dormant. However I suffer from terrible chronic fatigue, fibromyalgic pain. My immune system is compromised. I have said to the DWP and UC that our case is not having a home that's making capital. In fact I would imagine it's losing capital. I had a solicitor who wrote a letter in 2014 telling the powers that be, that the property shouldn't be used in means tested benefits, but they say it doesn't it doesnt count anymore. I have put in a mandatory reconsideration. I was supposed to be called by a case manager last week, but wasn't. I noticed my original migration form it didn't say anything about my Housing Benefit being stopped. They said they be able put the house out the equation, but the party must be over ****, a close relative (we don't live together and are still married for 30 years) and or ill. When I said that's exactly my case the decision maker said we only give it to step wives or Husbands. I've never come across a step like that before? I am always calm and polite. They don't listen. Send online letters telling you fill out the attached form, but I'd no attachment, North Somerset CC Housing Benefit said they don't deal with HB anymore? I've been pushed about from pillars to post. Every morning I wake up in tears. Thankfully I have full PIP. Now I'm worried about that. I took them to tribunal about and it was all agreed. I know I'm not the only poor soul struggling with this. They should look at each case. My friend who passed away at 52 with a heartvattack, said "don't live in fear, life is too short."Anyway that's my winge, but really it is absolutely frustrating.     Housing Benefit is one of the legacy benefits that ends when you apply for UC when of working age, if not living in sheltered or supported housing.

    It gets replaced by UC Housing Element.

    A property doesn't have to be making you money to be counted as capital, the value of the property itself is counted.

    Thanks for your Information.

    I have spoken to the CAB 3 times. They told me that I had to include the house. They didn't mention a UC Housing element.

    They also said I might have to pay back what I've had. I couldn't afford that. It's such worry.

    I'm waiting for a case manager to contact and I'm working with National Debt UK to free up some money I've been paying on credit cards. What happens with Council Tax?

    Council Tax Reduction is decided on at a local level, with each local authority having different rules.

    As a result it's really hard to advise on individual cases from here.

    Are you claiming Universal Credit as a single person or is this a joint claim?

    Hi Lauren as a single person. So could I get the single person allowance? I've already sent in Bank Statements. Maybe they haven't looked at that yet?
