ESA permitted work - average hours

Hello,

I have applied for a 14 hrs contract as it is within the permitted hours (and pay) rules.

However they run on banked hours, meaning that although the pay is the same every week, I would be asked to work less sometimes, banking hours to cover annual leave or absences. That means I would be working more than 16 hours at times.

Does anyone else have this situation , or perhaps know how the DWP view this.

I would check this carefully with the DWP. My understanding is that they will usually look at the actual hours worked, not just the contracted hours. If your employer uses banked hours and there are periods when you work more than 16 hours per week, that could potentially affect entitlement even though your contract is for 14 hours. Hopefully someone with direct experience of banked hours contracts can advise further.
