Hi, I’m just after some advice.
I was awarded lcwra on 26/4/21 but have been claiming UC with sick notes provided since November 2019. It took months of me chasing up to be referred for the health assessment and then due to an error my referral was sent back to UC and I had then had to chase up being re-referred! I finally had my assessment on April and received the award. The letter stated that if I would be notified on my journal if I was entitled to backdated payment.
I didn’t hear anything and do write a message myself and was told I had been awarded it backdated to November 2019 but I had to wait 3 months to receive it as there was a waiting period. Now I was under the impression that the ‘waiting period’ was the 3 months at the beginning of your claim and that they would deduct 3/4 months of the back payments? I questioned this and received the same reply that I had to wait 3 months and I couldn’t be told how much I was to get as it’s just worked out 3 months after the decision letter. I decided to ring up and ask and I was told that I was correct about the waiting period and there’s no reason why I haven’t received my back payment yet since I’ve began to receive the lcwra payments.

can anybody shed any light on this, it’s driving me insane being told different things but nobody actually knowing why.

thank you.

The three month period is from when you reported your health condition. If you reported in November 2019 it is likely the LCWRA element would be payable from March or April 2020. The exact timing depends on your payment date and the date you reported the health condition. If November 2019 was when you started the claim and the health condition was reported at that time the LCWRA element is payable from your fourth payment.

if necessary refer them to their own guidance

    Paragraph F5031
The relevant period is three months beginning
    1. in relevant threshold cases (where the claimant has weekly earnings at or above the relevant threshold and is entitled to DLA or PIP), on
1.1 the first day of the award of UC or
1.2 if later, the date on which the claimant applies for the LCWRA element to be included in the award or
    2. in any other case, on the first day on which the claimant provides medical evidence of LCW.

    thank you for your reply.

I think it should be backdated to April as I’m sure I declared it on 19th November and my payment date is 2nd. That’s fine and I understand that, I just don’t understand why I’m having to wait 3 months for the decision letter.

it’s frustrating going back and forward with the advisors as they say different things and when I explain the situation they agree with me but then say they don’t understand themselves what’s going on.

I’ll try and send the guidance, thank you.

How annoying. Like you I have gone back and for over the past 19 months, including them loosing my completed  form which had been delivered and signed for, luckily recorded delivery.  Medical assessor going sick on day of assessment, their IT systems going down on day of rearranged assesment.  I started just after you, at beginning of December 19 and thankfully this month got assessed and she said she was recommending LCWRA.

Did they sort yours straight away after?  I'm just trying to get an idea of how long I will have to wait till I officially hear and get amended money / backdate.
