Hi I just tried to contact UC on my journal about backpay and was told I won't have any backpay as the relevant period ends in this assessment period now I've been submitting fit notes from 25 march my assessment period is 20-21 and I was referred finally for wca in April no matter how I look at it I should have backpay am I correct I feel like I'm going insane

    There's a full 3 month waiting period and the extra money is paid from the 4th month after you reported your health condition.
    Based on the information you gave then your waiting period will be April/May, May/June, June/July.. LCWRA starts from AP 21st July to 20th August and first payment would be August 27th. If it was included in this months statement then they owe you 1 month @£354.28. Providing you sent fit notes without any gaps until a decision was made on your WCA.
    This advice is assuming you're not claiming UC with a partner that already receives the LCWRA element on your claim.

    Would it also include the September as it got paid a day after decision was made and not included in the calculation

    Yes paid from August. So they owe you 2 months. Put a message on your journal under the payment section and tell them the date you sent your first fit note. Also tell them that the 3 month waiting period starts from 21st April.

    Okay so I sent them a message like you advised and this is what I got back from them does this mean they're counting the 91 days from the date of decision now I'm so confused I don't know what to do here if anyone could help I would greatly appreciate it 

    I have sent you a copy of the outcome decision to your Journal the qualification date is the date of the decision and once the 91 day qualification period has expired if you think this is incorrect then you can ask for a manual reconsideration of the start date Thanks

    That is incorrect. The waiting period starts from when you reported your health condition, providing you sent a fit note within 7 days and continued to send them without any gaps until a decision was made.
    They very often get this wrong, which is disgusting to think they don't even know their own rules. You need to request the MR.

    You're welcome. We see it happen very often on here. It makes me so annoyed that they don't even know their own rules! Quite shocking!

    Hi again I replied to the message they sent me with a request for a MR of the start date and said what you guys suggested which I thank you all for but i haven't even got so much as a acknowledgement of it do I say it again or do I just wait

    I finally got a reply of somone but they sent the whole decision to a mandatory reconsideration is that what's supposed to happen I waited and been dragged through this for months are they able to reverse the decision I'm so scared now

    Yes because you requested it as you stated here.

    I'm sorry I just started to panic about it I got worried this would result in me losing the award fully are they able to do that ? Thank you once again for all your help

    If you stated you're requesting it for the start date of the LCWRA element then this is what they will look at and nothing else.
