I have my tribunal hearing via phone this month

Hi all,

This process has been so draining and affected my mental health. 

I had my initial assessment with capita over the phone and they made a decision in 2 days and I was scored 0 on everything. 

I was advised to apply for pip from my support worker.

I have been diagnosed with anxiety, depression and ptsd along with all of that affecting my IBS. 

I was in an abusive relationship for 5 years and thats where my mental and physical health declined. 

In my assessment the assessor did not ask me hardly anything about most of the descriptors. 
She also lied and said I make it to the toilet which is upstairs and I live in a 1 bed, 1 level flat. 

I am on the waiting list for therapy and I have a mental health nurse now and I am on constant changes to my meds as nothing as worked in the past year. I have not left my house for the past 2 years. 

I have not seen my family since 2020, I live 3 hours from them and have been isolated, I cannot make the journey due to my anxiety. 

I am so nervous about my appeal because just like the trauma of being in an abusive relationship and fearing not being believed, it has triggered me being lied about in my assessment and not being believed. 

Has anyone had a telephone tribunal and does anyone have and advice or tips please.

    It sounds as though you've got a lot on your plate at the moment. I've sent you an email from community@scope.org.uk to see how we can support you. 

    Are you getting professional support from a representative to help you with your upcoming tribunal?

    Hi @Tori_Scope thank you I will do that now. 
    And I do not have a representative, I have done it all on my own and I regret not having the courage to try and get help with it. x

    UPDATE!!


    Had my tribunal today and won!

    It was very stressful but the judge was lovely.

    They asked me to take a break and they would call me back. They called back and said they would not put me through anymore and awarded me enhanced for both for 4 years.

    The judge said it was not to be changed and back paid for a year.


    It’s been a long year from being awarded 0 points for both on my assessment and MR.


    I had a lovely representative from my local council and he pointed out that capita had not given me a fear or thorough assessment via the phone. 


    I have IBS, asthma, anxiety and depression and ptsd. All of which are triggered by eachother. 


    Don’t give up because I nearly did. Xxx

    I’ve not been well due to the anxiety from my hearing so my ibs has been really bad but I am so happy it is over.

    i am glad I kept pushing back and did not give up and fully recommend having a representative who knows about pip and the descriptors.


    To any one questioning if they should go all the way and appeal, do it!!! Xx

    You are welcome @Yazzy186. It is the very least you deserve.

    It sounds like you've not been well due to the anxiety from your hearing. How are you feeling about things at the moment?

    I hope you are starting to feel better about things. However, if you need any help, please don't hesitate to reach out to us.
