Do you receive contribution-based ESA?

calcotti

What type of ESA do you get?

Does your partner already live with you? If so getting married makes no difference you should already be declared as a couple if your benefit is means tested.

if you currently live on your own then If your ESA is income based does it include a Severe Disability Premium?

What is your PIP award?

Loooyjupes

Hi calcotti yes I get the premium we don't live together

Loooyjupes

Hi rate pip

calcotti

If your partner moves in you will lose SDP.

You say your partner doesn’t claim any benefits themselves. Are they working or what are they living off?

By high rate PIP do you mean the enhanced rate of both components (Daily Living and Mobilty)?

Key point in respect of benefits is that being married makes no difference, what matters is whether or not you are living together.

Loooyjupes

@clacotti long story but his mam has provided for him he used to be self employed, what is SDP, and I get enhanced rate for both

Loooyjupes

@bg844 hi income related I think

poppy123456

SDP is Severe disability Premium which is added to your Income Related ESA if you live alone (or classed as living alone), no one claims either carers allowance or carers element of Universal Credit for looking after you.

How much is your ESA per week? If you can tell us this we'll know what it includes.

I asked if you got the Severe Disability Premium (SDP for short). You said that you do. If he lives with you then you will lose it.

Does he have any health issues himself that limit his ability to work? Does he have any savings?

(Way off topic and possibly inappropriate but have considered whether, having now got used to living off his mum, is he going to expect to live off you? Please don’t answer that question here but just seems something to consider.)

@calcotti he was being paid by mother to help with now deceased father in law, also partner waiting on operations on his knees so is unable to work, actually he would have to think about benefits anyway, so how would all this effect me, also I don't want to go onto universal credit

Loooyjupes

@poppy yes I get SDP sorry I had a mind blank

calcotti

Apologise if I was being intrusive or insensitive.

You would have to report that he is living with you and your ESA will be revised to take him into account.

He could claim Carers Allowance for looking after you.

You can use a calculator to see what you could get. As a couple you could well be better off on UC.

Do you also claim Housing Benefit?

Loooyjupes

Yes I get housing benefit

Loooyjupes

And I am permently sick

When he moves in with you, you will need to report the changes to ESA and your SDP will stop. They will then revise your claim to include your partner, however because of the loss of the SDP your ESA will be less.

As you're currently living alone you will also need to report the changes to your local Authority and your council tax reduction will be recalculated. You will lose the 25% single person discount.

Your PIP will not be affected. If your partner cares for you for at least 35 hours per week then they can claim carers allowance.

You may also want to use a benefits calculator to see if you would be better off by claiming Universal Credit.

If your partner has savings/capital of more than £16,000 then you're entitlement to means tested benefits will end.

So basically I'm better off living on my own lol 😂
