Good morning

I got a letter out of the blue my pip tribunal I have been put back onto original award for both daily and mobility quick question.

From March 2023 I was getting standard daily living only.
Now I won both daily enhanced and mobility enhanced how much roughly would I RECIEVE and grabbing at straws what sort of time scale.

23rd march onwards daily living standard that's all.

Great news. How long you'll be waiting for the money that's owed will depend on whether the decision was made by the Tribunal or DWP. If it's Tribunal then it can take up to about 8 weeks. If it was DWP then it would be quicker.

From 23rd March up until last week it's 20 weeks so it's about £2,000 they owe you. I can't tell you the exact amount because it will depend on when the cut off date is for the money they owe you.

Hi I phoned them told letter was sent to me on 10th and should be 4 weeks after that I think they thought I was on about my new rates not backpay.

I already received a letter from tribunal dates the 10th is that the one the dwp said they sent on Thursday.

Am I correct in thinking I was on standard daily at £271 a month now I won award it should been £691 meaning I will get backdated roughly £420 a month from 23rd march award notice that was set aside by tribunal.

Then it can take anything up to 8 weeks to receive the money you’re owed.

At the moment your PIP is £272.40 ever 4 weeks, not monthly. Yes it will increase to £691 every 4 weeks once the award is put into payment.

It’s not an extra £420 each month because PIP is a weekly benefit paid 4 weekly.

The calculation up until last week is about £2,000 that you’re owed. This will increase each week the longer you wait for the award to be put into payment.

Dose this look correct if my money was on 24th that's 4 weeks from 10th I believe like I was told on phone.

22 weeks if 24th August

22 x 172.75 = £3800

22 x 68.10 =£1498

= £2302 if on 24th August

You will have about 2.5 weeks at the old rate. (before the April increase) The rest at the new rate. Yes those figures look ok but it will depend on exactly what date the cut off is for what they owe you and i'm afraid i can't help with that. I won't be able to tell you exactly how much they owe you. You will need to wait until it's paid into your bank.

2 weeks

Daily £8.83 x 5 = £44.17

2 weeks at £30.55

5 days at £8.83

= £105. 25

Would that be roughly 2.5 weeks they would stop that they already paid me.

Thanks a lot silly question my money is normally paid on a Thursday so is that where the week to week is calculated and would I be paid on sale day as my pip is due.

Yes, PIP is paid 4 weekly in arrears. You’ll continue to get paid on the same Thursday as you do. The only exception is back payments and these can be sent anytime.

As you were awarded by the Tribunal and not by DWP as i advised, it can now take anything up to 8 weeks for DWP to put your new award into payment. The decision letter that was sent to you on 10th is highly likely to be the decision from the Tribunal and not the decision letter from DWP.

There's nothing more you can while you wait for DWP to put your new award into payment. I know it's difficult but please try to focus on something else while you wait.

Fully understand and ty for the help just been months without my old award it is like the dwp are punishing me it's all so wrong.

Could I get backpay the old rate then new rate I'm bit confused because have payment due on 24th.

The money that's owed to you will be a mixture of the old rate and the new rate. The new rates started from 10th April 2023.

It's likely an error but you'll need to contact HMCTS to ask.

You really need to either edit that screenshot and remove all the personal information such as names of the Judge and the rest of the panel names, including your own full name or you need to remove it completely. It's against the rules of scope to post personal information like this to protect you and other members.

I flagged your comment to a member of the scope team just incase you don't manage to remove the information in time.

It says the decision made by Secretary Of State was set aside and you've been awarded Enhanced daily living.

I'm assuming you already scored 2 points before the hearing because it says you scored 13 points in total but looking at the descriptors there i see it's only 11 points.
