Lcwra and carers element

I am in a joint uc claim with my partner. I receive the lcwra element for myself. My 8 year old son receives child disability payment(middle rate) . Can my partner claim the Carers element of UC for our son?

Yes they can. They will need to report a change of circumstances and then click caring for someone and report it through there.

Thank you. I had originally tried to claim but got told as I was in receipt of lcwra I couldn't. This was back in February 2023, when my son got awarded. Could my partner get this backdated as we weren't advised we could at the time?

Yes, the same person can't receive both elements at the same time. You can ask for it to be backdated and tell them what's happened. As they would have known you were claiming with a partner at that time they could have advised you that your partner can claim it, instead of you. Very poor advice.
