UC Migration

Hi everyone,Hope you’re all well.Myself and my husband have migrated over to Universal credit on the 15th August 2024.It was a telephone claim as we are both disabled and find it difficult to do it online.Also husband didn’t have email address.When I rang for a read out of our statement it was all wrong missing out our disabled son who lives with us so we had to pay for a spare bedroom.And we both are carers My husband for myself and myself a carer for our son.I raised this miscalculation of our UC benefit and a Case manager phone me today with a recalculation of our UC .We had no transitional protection going from Income support to UC and of course charged bedroom tax .We both receive carers allowance as a separate benefit and like I said both disabled.Is it worth one of us or two of us going for LWCA as we were told from case manager we would get extra money but what I’ve read only one of us would get the extra money even if we were both awarded LWCA and would we lose anything from UC ? As it a joint claim.I would be grateful if someone can help

    Only one of you would be entitled to extra money if found to have LCWRA. However, you would then lose one carers element because the same person can't receive both carers element and LCWRA element at the same time.

    Regarding Transitional Protection, it's not unusual for it not to be calculated in time for your first payment. I hope it's now be resolved.

    There's also no non dependant deductions because you're claiming a qualifying disability benefit.

    Please also note, that if one of you does go through the work capability assessment if found to have LCWRA and your UC includes Transitional Protection then this will erode when other elements are added or other elements increase. For this reason you may not be any better off by the addition of the LCWRA element but it will depend on how much TP maybe included with your UC.

    Good Morning Poppy we will not know until next week the amount we have been properly awarded.But I really don’t know what to do about WCA .I think I may wait until next week and for our statement to come out to us before making a appointment with the doctor for a letter .I thank you so much for your response and wish you a good day ahead.
