Universal credit
hi I have a question,
my partner has just been awarded LCWRA ,
And he has been ill for last 5/6 years and also diagnosed with Tourette’s , he also claims pip, he has a work assessment in September 2024 and has been awarded LCWRA ,
Now the last sick note we handed in was back in July 2018 I have had a phone call with UC today to confirm this and the last also has told us that we will be getting back dated money back to 2018
Which is what I’m really confused over is this likely to happen and why has it taken 5/6 years to finally get recognised he’s not fit for work ect
Thanks

Good morning @don11
Whether or not this can be backdated is up to a decision maker, and it may depend on the duration for which the fit note was issued. Is there a reason he stopped providing fit notes to Universal Credit?

yeh we were told that he no longer needed to hand them in
I just don’t think that it will be back dated to 2018 to be honest but this is what I was told on the phone to UC
The letter dose state we will let you know if we owe you any monies
just abit confused of why it’s taken from 2018 until now to decide he’s not fit for work when we have knew this for years but nothings happened until now

On another thread you mentioned reviews for the work capability assessment. As no fit note have been provided since 2018 this sounds like it was a review.
If you previously had LCW rather than LCWRA and this was a review started by DWP then the extra money will be from the assessment period in which the decision was made.

so we had a review back in dec 2023 then we had to fill in forms in January and heard nothing till this phone call in September then received this letter this week October 2024 advising he is being moved on to this , so I’m not sure when the assessment period actually is,
not sure why the UC said it would be back dated to 2018 then lol0 -
I have no idea why you were told that but because you already have LCW and this was a review started by UC then usually there's no money owed.
If this was your very first WCA or your reported changes to your health conditions then it would have been different.
