hi just joined. Feeling really stressed out. Got 0 points from Maximus, made huge complaint to them and asked for MR at DWP. Have received complaint response and they insist their assessment is valid, even though the response makes out only on assessor did the report even though two sessions were needed and two different people. It says that they all have training and because I work adhd is not causing cognitive of functional issues (even though I provided adhd assessment and diagnosis report that shows have got functioning issues due to it). Feel so worn out and exhausted by it all. Feel like need some help with it all. Maximus also said that some complaint points will never be answered as the call was not recorded. And that because Iv not had a change in medication for 7 years (not the case)I can’t have any issues with annxiety (I said in anssessment I was anxious most of the time, even though I’m on medication, just without meds I’d be even worse/not alive) Any advice or similar experiences anyone please? Would love to hear, thanks a lot

    Hi,

It would be best to start a new topic with this rather than adding to an old topic.

Have you got the result of the MR yet? Or just a response to the complaint?

If the MR has failed as well then your next step is a tribunal. The tribunal judge is impartial and will not necessarily agree with the way Maximus have decided your lack of evidence is proof of no functional issues.

Anxiety alone is not a functional impairment, only when it becomes severe enough to prevent you completing the PIP tasks.

From your post, I can't see any functional impairment at all. You don't have to share that with us of course, but if you only said the same sort of thing to the assessor, then I do understand why it ended with 0 points. You need to give real world examples of what's happening when you attempt tasks to evidence the fact that you cannot complete them reliably and within a reasonable timescale, for example.

thanks for replying, sorry if Iv posted in the wrong section, I’m new here so need to learn how it all works. Not got MR result yet, think I need to follow up the phone call with a letter. Also think I need to let DWP know that there’s a response to the complaint from Maximus, but I’m not satisfied with their response, so I need to reply, but I’m getting very overwhelmed with it all, and not sure what order I need to do it all in to make sure I’m following process. It’s not anxiety only that is impacting my functioning, I have severe and combined ADHD, CPTsd and fybromialgia, asthma, ibs and other bits that are still under medical investigation. I v really struggled to get everything odown to explain things. I did provide ADHD assessment which shows the clinician has written I have severe functional limitations because of ADHD symptoms but it seems to have been disregarded. I had put in the application for PiP what I struggled with and that my partner helps me to eat and drink but the DWP have said it reads as if this happens because I’m lazy rather than having functional problems. But all my struggles are compounded and I really struggle to explain it all properly. Thanks anyway. I will figure out how to start a new thread.
