Good Evening Everyone, I was looking for some advice please on the following. I submitted my first fit Note on the 10th July 2023, and have continued to supply fit notes up to the end of this year. I have been awarded Limited Capability for Work and Work Related Activities on the 27nov 2024, I didn’t hear from LCwA till nov 10th this year for my Assesment as apparently they had only just recently been informed about my case , my back dated payment was for 4 months,so from Aug 2024. Am I wrong in thinking that it should go from my first fit not supplied plus the first 3 months assessment and payments should have been back dated to nov/Dec 2023? Or is there a maximum backdated amount? So can’t be over 4 months maybe? Any advice would be appreciated and I hope this makes sense. Also I’m a single claimant Assesment period is 8th-7th every month Thanks Tom

    There is no maximum backdated amount. You are correct with your thinking on backdating.

    Did you continuously supply Fit Notes with no gaps or breaks? It is the date they were given to UC that matters the most.

    Hi Kim no gaps or breaks in Fit notes not that I can tell from my journal.

    In that case, I would add a note to your Journal (under Payment) and ask why LCWRA has only been applied to your claim since August 2024 when you have continuously supplied Fit Notes since July 2023.

    If you believe the answer you get is wrong, or a gap in Fit Notes is revealed, you can request a Mandatory Reconsideration disputing the date LCWRA has been backdated to/asking for the gap to be disregarded.

    A Decision Maker will then look at the issue.

    Again, if you feel the reply is incorrect you can proceed to an independent appeal tribunal.

    This is probably not going to be of any help to your case. I am just shocked that DWP took over a year to make a decision. When did you have your health assessment? Was this your first health assessment or a review? Ty
