Hey all

Sorry in advance if this question has been answered ( probably multiple times)

We Migrated over from housing benefit to UC in Aug 24. Cut a long story short:Husband has been sending in fit notes and filled in the UC50 form/assessment completed.

First week of January he was awarded LCWRA-reading through the letter on our journal it says: re extra payment
You will not get it if you have a partner who already gets extra
money for a disability or health condition

I receive pip - standard rate for daily living

Does that mean he’s not entitled to any extra payments?

    PIP is irrelevant for UC purposes, the letter means if you yourself were getting LCWRA then no extra money would be paid, as one LCWRA element is the maximum payable within a couples claim.

    If you were getting any Transitional Protection with your UC this will reduce by the LCWRA amount.

    Thank you for your reply @Kimmy87 I am unsure if we had transitional protection as wasn’t claiming any other benefits apart from HB via the council ?

    We will just have to wait and see if he is granted any LCWRA payment( still not received the letter that’s been added to journal and nothing about payment on there) our payment date is 12th of every month-fingers crossed x

    LCWRA has a waiting period of three full assessment periods, from the date the first Fit Note was handed in. No money is paid or subsequently owed for that period.

    What date did he report the health condition?

    What date was his first Fit Note?

    Were there any gaps in handing in Fit Notes, any that were backdated etc?

    When you have access to a journal, you don't receive letters in the post, they are only uploaded to the journal.

    If there was Transitional Protection added then you would know because it would tell you on your statements.

    Are you receiving the LCWRA element for yourself?

    Does your partner claim carers element for looking after you?

    What date exactly did he provide his first fit note?

    First fit note went in the week we started our claim ( 8th Aug) No gaps he has been adding new ones as soon as old one ran out.

    Thank you , I wasn’t sure if they’d send paper copies :No carers element, I don’t receive LCWRA, I can’t see anything about transitional period on either of our journals, first fit note went in 8th Aug 2024

    If your payment date is 12th of every month, this means your assessment periods are 6th to 5th of each month. If he reported his health condition at the start of your claim on 6th August 2024 then his waiting period will be as follows…

    Aug/Sept, Sept/Oct, Oct/Nov.. LCWRA starts from assessment period 6th Nov to 5th Dec and first payment will be 12th December. This means up to now they owe you For Dec and January, assuming it wasn't included in last months statement. If it wasn't then it's likely because the decision was made very close to the end of your assessment period.

    Money owed it paid separately to your usual monthly money and often takes quite a few weeks to pay it. As the decision was made at the start of last month I would advise you to put a message onto his journal and ask about the money owed from LCWRA.

    You will need to check this months statement when you receive it to see if the element is included.

    Thank you @poppy123456 that’s our payment/assessment period so hopefully we’ll see what has been awarded ( or not ) within the next day or so 👍

    Just extra info:not sure if relevant

    UC50 form was received by them 4/11/25

    With Decision maker 6/01/25

    LCWRA letter on journal 23/1/25

    Does your partner claim either PIP daily living or DLA mid/high rate care? If so then you can claim carers element for looking after them.

    Morning all once again thank you for all of your help - a message appeared on our journal last night they have award my husband his LCWRA payment on this months claim period . They have also adjusted any previous months to reflect this so we will get a separate payment paid the same day.
