Hi, My daughter has been awarded DLA for 1 year. If I tell UC I lose my transitional protection and if my daughters DLA stops next year I'll be worse off because I've lost the transitional protection. Also, if they back date the disabled child element I will owe them money because they've paid me the transitional protection. I'm really worried, what do I do?

    How much is your transitional protection? In terms of backdating of the DLA this isn't usually backdated unless you request this. So if the backdating will cause an over payment of UC you don' have to request the backdate. I would suggest that you speak to an agency such as Citizens Advice or Welfare Rights for advice.

    Hi, the DLA has been backdated but if the child disability element is backdated I will owe them money as it comes off the transitional and and I've already been paid the transitional protection which is why I'd owe them money.

    I don't think we can give the correct advice without knowing how much your Transitional Protection is. Also what was your daughter's DLA award?
