Hi i think im going to get in trouble, ive 8.5 k in two current accounts, im a single person recieving uc +lcwra and the standard element of dla, ive read anything above 6k ill get a deduction of my UC , around £4 per £250 is that correct? so will they base my deduction on £3.5k to much? and how far does that go back , or is it simply based on how much you have "over" at the time of the review?

Thanks ia

If you received any Cost of Living Payments they are disregarded indefinitely (unless your money went below the amount you received), you need to tell UC how much you received as this isn't done automatically.

They will likely ask for individual statement pages showing those payments in to do the calculation.

The deduction is £4.35 for every £250 over £6k or part thereof.

They may ask for statements further back to see when you went over £6k.

There probably will be a small fine of £50.

Thanks, so what i think your saying is its also the length of time it was over the 6k limit, what bearing does the length of time have on the sanction/deduction? also regarding a potential fine, is there any way to find out what that might be, dwp info?

    Thanks

Going forward the deduction would be applied for savings.

Looking back they would need to calculate the overpayment of UC that you received, you would need to repay that money.

The fine is fixed. Turn2us have a guide including information on the fine:

I think i understand so if 2 yrs ago i went over 6k and that meant i had received lets say for eg £800 in total to much UC they'd then deduct that from my UC 4 weekly amount now, presumably in installments, and then going forward , they'd be a deduction for being over at the rate mentioned, oh and a civil penalty

    Is that about right (roughly)
