WCA statement of reasons of MR

Hello,

Could someone, please, tell me if there is such a thing as statement of reasons of mandatory reconsideration? Or is it called something different? I have requested it on UC journal, but they don't understand what I want.

I had MR for WCA, the decision was changed from able to work to LCW and I'd like to see how they came to that decision. So I assume statement of reasons is something I should ask for. I don't know if I should appeal to court yet or not.

    Hi,

    You might be better off asking for an 'assessment report' instead.

    Though the journal staff only get very basic training so you may just need to try a few of them until you find one that understands.

    I did ask for the report at first, they post me a medical report instead, which I already have. So then I asked for statement of reasons and they asking whether I want decision letter, which they already attached on my journal, posted.

    They have sent me statement of reasons before the mandatory reconsideration, so they know what it is, but after MR they seem to struggle to understand. Don't people need that if they are taking them to court?

    Thank you for clarifying. I'm afraid I don't know whether any extra paperwork is produced at MR separately from the decision letter. Hopefully another member can confirm that.

    The next stage after MR is a first tier tribunal. It's not a court. There's no need to have any paperwork for that.

    Only if you fail that tribunal do you then have to appeal to the Upper Tribunal with an Error of Law. That is when you need the Statement of Reasons, but that comes from the first tier tribunal, not the DWP.
