Hi!

Can a Housing Association ask what my disability and religion is and can they ask for proof if I’m having problems with harassment from a neighbour due to my D&R?

    Hi @Fibleepy

    No, a Housing Association generally cannot ask about your disability or religion and they cannot ask for proof of it, unless it's necessary to make reasonable adjustments or assess eligibility for specific housing schemes.

    Could they ask me to prove these things to show that a neighbour is bullying me?

    They can ask you, yes. But you don't need to disclose the information. Though if it would help in your case against your neighbour, I'd give them all the details they ask for.

    The neighbour knows I’m disabled but doesn’t know what my conditions are and they don’t know what my religion is but I feel they are aware that I’m some kind of “weirdo” (to quote them). I still think the Law cannot force me to disclose my (hidden) disabilities and my (private and personal to me) religion and even the police should not ask.

    The Equality Act 2010 makes it unlawful to discriminate against someone because of religion or belief, or because of a lack a religion or belief. You cannot be detained by an officer for not disclosing your religion or any disabilities and you do not have to disclose your religion to anyone if you don't want to.

    But again, if you are being discriminated by your neighbour due to your disabilities and religion, it may be wise to disclose this information, as it could give them more information to act upon.
