Good afternoon,

I have a query about making a claim for the LCWRA of UC and Talking Therapies treatment.


Firstly, I have a stutter which has been described as significant by medical professionals and I already claim PIP where I gained 8 points for this.


I also do not like engaging/mixing with other people. Largely because of my speech. I gained 2 points for this on PIP but this was after an offer before it was set to go to Tribunal. In reality, I probably should have more points for this and may have gained more at Tribunal.


Since then I have gained more solid evidence regarding my speech and ability to engage with other people, including my full medical records and a letter from my GP.

I currently have fit notes in with UC and am waiting for my UC50 so I can make a LCWRA claim. I am also about to start Talking Therapies treatment via video call for my anxiety/social anxiety/depression and possible PTSD & Personality Disorder.

My question is whether this would be held against me with regards to my claim for LCWRA? As elsewhere I’ve seen someone’s claim was refused at the Tribunal stage because of this. This is what the refusal from the Tribunal said :


‘6. Whilst the tribunal accept The Claimant has limited capability for work and scores 15 points under activities 15c and 16b, the tribunal did not find limited capability for work related activity. The Claimant had already engaged in some of the activities he might be expected to do in the work-related activity group, such as engaging with CBT and Talking Therapies.’


So does this mean I would not get LCWRA because of engaging with Talking Therapies via video call?
