Good morning

May I ask has anyone successfully appealed NHS ill health retirement refusal and won at the 1st stage of appeal .

Ive recently been refused as no one can say for certain that my condition is permanent! I have heart failure and heart disease and may possibly need a heart transplant in the future .Although everyone agrees I was not fit for work when I was dismissed due to ill health apparently I don't qualify for ill health retirement?

Any advice would be greatly appreciated.

    Good morning

    Can I ask has anyone been refused NHS ill health retirement and won the 1st appeal ?

    I've recently been refused on the grounds no one can say if my condition is permanent! I had a heart attack last year and now have heart failure and heart disease and may need a heart transplant in the future which apparently means I might improve and be able to return to work but as my consultant has said no one can say for certain only time will tell.

    I left my post in the NHS in May 2025 due to ill health and everyone agreed I was not find for work then and I am still not but apparently that doesn't count

    I'm 52 and in both the old and new Pensions and I've also been told my age goes against me as well as I have 14 yeard time to improve before my normal retirement age at 67 .

    Any advice would be greatly appreciated.
