Is the Benefit Cap amount backdated If a PIP tribunal is successful?

Hello

I wondered if someone with some experience in this, could possibly assist me in establishing whether or not, I am eligible for a backdated UC payment, after winning my PIP tribunal.

I applied for PIP on 29/07/24, and was awarded by a tribunal on 09/09/25.

I am aware that the PIP award will be backdated to the date of the application.

I am also aware that receiving PIP exempts me from the benefit Cap associated with UC. What I am unclear about, is whether or not I can request the difference between the benefit Cap sum, and what I have actually been receiving, post Cap deductions, from UC, July 2024, to date.

E.g.

Total UC Entitlement: £1,800

Less Cap Amount: £800

Total Payment in Bank: £1,000

Can I now ask for the £800 that was deducted each month, to be paid back as of 29/07/24?

I'm seeing so much conflicting information and I simply want to know if I can post a message in my UC journal asking for the backdated sum to be calculated, and a payment date agreed.

Honestly, any clarity on this would be really appreciated.

Yes you can write a Journal note requesting your benefit cap be lifted as of 29/07/24.

Either your case manager or a decision maker will then look at your claim.

You'll know when this has been sorted in your favour, as a letter will be added to your Journal stating the amount owed due to underpayment. The money will then be paid within a few working days.

    Hi Kimi

Thank you for responding to my query.

I'll post a message in my journal and let you know how I get on.
