Hi, my name is Leelis! Should my patient be entitled to carers element if his wife is on LCWRA?
Hi,
I am helping a patient and his wife about a joint UC claim. They both have health issues. My patient is 62 and wife is 52. They made a claim for UC and get all elements except carers element as the patient despite his kidney problem does look after his wife and do all the running around like shopping , driving etc. In their UC there is one payment of LCWRA . even tho he did decalre he looks after his wife full time , no carers element has been granted.
They are both on PIP, him on standard rate for PIP and se on enhanced rate for both.
Pls advise whether carers element should be granted to the husband pls.

The same person cannot get both Carers Element LCWRA. If both apply then the higher amount applies, which would be LCWRA.
So if the LCWRA is in his name, he cannot get Carers Element.
