in Universal Credit (UC)

Hi please don't judge me as life is hard enough I need to ask something that has got me badly bullied on another site 😥.

I receive UC,PIP and carers allowance I suffer from many major health issues including chronic heart disease and cancer. I'm a carer for my disabled daughter despite my own health issues but I see it as she is my child and I do my upmost as a parent to look after her.

My question is I have another daughter who claims UC she visits regularly to help me with my own issues would she be able to claim carers element for helping me?.

If she can would it affect my own UC of which I have transitional protection, any advise would be very much appreciated,

    As long as your visiting daughter doesn't get LCWRA on her own UC award, and provides over 35 hours a week care, yes she can claim Carers Element.

    It won't impact your own UC award or Transitional Protection.

    If she does get LCWRA element, then it's not possible for her to get Carers Element.

    This is because the same person cannot get paid for both and the higher amount applies, which is LCWRA.

    Thank you so much for your reply, no she doesn't get LCWRA but I do for myself.

    On her own claim her husband gets carers element because he claims carers allowance for their little girl.

    Can you get carers element twice on a claim?

    Yes two carer elements can be paid in a couples claim, if two different people are being cared for.

    I'm so sorry to come back and ask but this one thing is playing on my mind.

    I transfered over to UC from income support and I was getting Severe Disability Premium so on UC I get transitional protection so I'm no worse off, so if my daughter was to claim carers element for the help she gives me will my transitional protection on my UC be affected?.

    Thank you for any advise.

    On legacy benefits, SDP would have stopped in those circumstances.

    SDP does not exist under UC, the Transitional Protection is a financial amount to make sure you aren't worse off at the time of transfer.

    Someone claiming Carers Allowance for looking after you, is not a change that impacts your Transitional Protection.
