in Start here and say hello!

Dear sir/madam,

My carer and respite home say that I must hand my money in when I go there because my wallet got lost or stolen, but does this mean that I lack capacity to keep it on me?

    Hi @DJBowery and a warm welcome to the community from me!

    Have you had an assessment under the Mental Capacity Act to see if you do have capacity? I wouldn't think they would be allowed to take your money if you do. And if they do take it, do they give it back to you?

    Hi Santosha12,

    They would allow me to manage £20 on my card but they said that they'll hold onto the same amount in cash whilst I'm there.

    Hi Santosha12,

    My carer is my appointee and she's agreed with the respite home that I can still take the money out with me but that they'll hold onto it on the premises.

    Hi guys,

    When you write "I don't think they would be allowed to take your money if you do" and "it is highly unlikely that a place you go to for respite can decide that on their own" it makes you guys sound unsure.

    But the google AI assistant told me that Scope have workers and volunteers that provide legal advice.

    Click on your avatar in the top right hand corner, then press the box with the head and shoulders in it, this will allow you to "edit profile".

    Then look at the left of the screen, where written in pink is "privacy". There are 3 boxes to tick or untick as you please.

    Hi Mary,

    You asked me if I had an assessment and, yes, I've had two. One when I was 16 and another when I was 23. And they're not saying that I can't manage my money just not in cash form. To be clear, they'll hold onto it on the premises and I can have it with me when I go out. Furthermore, I could still have £20 on my card if the home didn't insist on a portion of that being in cash for taxis and takeaways.
