Trinunal Win

I finally had my Tribunal yesterday and went from Standard care to Enchanced, no Mobility to Enchanced. I am truly shocked and relieved the year of tears and stress are finally over.
I honestly believe if you have the strength and determination which is so hard to do you can do it.
I can honestly say after reading some horror stories about the Tribunal i was very stressed and a nervous wreck, i attended with my daughter who has helped me along the way, also my eldest daughter who came to my original assessment. I am still shocked at the outcome if you truly believe you can fight the end do so.

    It took around 7 months in all. Also i supplied the tribunal 3 yrs worth of medical history and all my reports from my neurologists.
    The judge said this helped the Doctor and Disability Specialist and my oral evidence greatly.

    Im going to get a copy of my medical notes, that's not too long seven months, thouhht it msybe alot longer.. thank ypu for your message and all the best for the new year x

    Thank you and good luck, GPs do not charge for the medical notes they are free of charge. I am glad i sent them in it did help my case. All the best for Christmas and New year x

    I am so glad for you. You are right to mention that you have to have the strength and determination to see a Tribunal hearing through to the end. Not everyone has that ability due to illness/disability.
    One thing does surprise me is that the Tribunal appreciated all of your medical records.
    We are told constantly that these are generally worthless as they may not indicate how the disability affects you and which descriptor fits. Seems that they are  actually of good value?

    Congratulations, I have said time and time again on this forum  get your medical records for at least 2 years. If you send them into the HMCTS at least 14 before the Tribunal hearing  they will give the medical member of the Tribunal to assess symptoms and the impact on daily living. Once again  congratulations, it is worth fighting, if you believe your cause is just.

    I decided to send in 3 yrs worth so they could see my history, medication and what impact it had on my daily life.
    I felt i had a fighting chance so that is why i continued to the end. My advice is get your medical records for last 3 yrs and send medical evidence in from any consultants you are under.
    Judge said reading through of of those reports and my oral evidence helped them make there decision.
    I wish everyone luck, its hard going not easy but if you believe you was unfairly assessed keep going.

    I submitted two huge reports that not only gave details of what were my conditions but results of tests (as to walking ability) from the hospital, how all of my problems impact on my life and what the future holds.
    Unfortunately those reports whilst as relevant today as they were when they were written, were dismissed by the DWP only on the basis that they were 5 and 6 years old and consequently were not materially representative of my current position.

    @lindadenise great news! As i keep saying, evidence can only be used if it's less than 2 years old, isn't true.

    I know, I know, but you telling me one thing is different to what the DWP have told me.

    I sent my 3 yrs of medical evidence straight to the tribunal @Yadnad. They said it was a good thing to do because the Judge sometimes adjourns and requests 3 yrs of history.

    I'm not disbelieving you! The DWP up until recently made a song and dance on the PIP2 that evidence more than 2 years old should not be sent in (conveniently they have now removed that wording from the current PIP2).

    I did ignore it and sent in evidence that was between 5 and 6 years old but still relevant. It was the decision maker that refused to entertain the reports because they were more than 2 years old!!

    Ironically that same evidence when it was sent in for the previous review in 2015, two years earlier it was then between 3 and 4 years old - yet because of that evidence they changed the decision at MR stage from 0 points to enhanced care & mobility for another 2 years - to 2017!!

    Hence my confusion and lack of understanding.

    I understand they change the goal posts to suit them.
    I was really dreading the tribunal yesterday i was awake all night and by the time i got i was shaking non stop. I must say the Judge the doctor and the disability expert were very nice. I was questioned for about 40 mins. I was pleased that i would get to know the outcome the same day.
    It is hard going and i understand why some people just cant go through with the tribunal.
