LCWRA waiting time

Hi

I have been notified last week that I have been awarded the LCWRA, and will be notified with any monies owed to me within 7 days, and any monies owed to them be taken into account.

I contacted them this morning, asking if regarding any additional payments regarding the additional payments due to the LCWRA will be paid and as what would be the additional monies be?!?.

I had a response this afternoon saying:

The decision was made on 30.03.21, so there be a 3 months waiting period there after, April to May, May to June, June to July.

I'm a bit confused, as I when I applied for UC in December, I mentioned my health conditions then.  And when I finally got a regular Employment Coach and she asked about my health conditions, of which I advised, she recommended the work capabilities route, and advised to update my health conditions and to ask my GP to back date fit note to December, which I did all of this and filled out the forms etc. I thought the waiting time would be from December onwards, not March, has anyone else had this?!?

(I tried to call UC and he advised me to leave a note on Journal, as he couldn't help.  Which I did this evening.?)

    Hi there

The award should be backdated to when you first reported the condition and supplied a fit note then add on the 3 full months waiting period

Put a note in your journal and flag it as payment query then your case manager will be able to see it

Let us know how you get on

Do Scope have a section on their site regarding LCWRA?

Maybe a thought for their team to look into if they don’t.

Did you declare them as part of your claim and support this with Fit Notes from your GP?

@calcotti The fitnote was sent at later date. But I did mention that I have a disabilities when I made UC claim initially. Hence why Employment Coach wanted further information

They may only take the relevant period (3 month wait) as starting from when you provided details of a Fit Note. The regulations permit you to self certify for 7 days only.

@calcotti Makes sense of what you are saying. I aware of self certify of first 7 days through my old job.  Thank you for your information

What is incorrect is the advice given to you that the three months starts from the decision date.

It should start from when you reported the Fit Note details or, if they cut you some slack and given that you got a backdated Fit Note, from the start of your claim given that

@janer1967 Morning ? I have received a response this morning, and was told that it will be taken into account from when the decision was made,  and when I first notified the fitnote. And they explained why the 13 week waiting period. I have responded back, to say why I am confused, as was on the understanding by employment coach that the date of fitnote would be taken into account, and when my health conditions were mentioned. And some disability groups have mentioned similar. Hence to why I have the confusion.

@calcotti Morning,  I have received a response this morning, and was told that it will be taken into account from when the decision was made not when was made, and when I first notified the fitnote (not the date of the fitnote) . And they explained why the 13 week waiting period. I have responded back, to say why I am confused, as was on the understanding by employment coach that the date of fitnote would be taken into account, and when my health conditions were mentioned. You are correct when you mentioned it start when I reported the fit note, not the date of the fit note.  And thank you for the information ?

Sorry but that doesn't make sense. It can't be the date the decision was made and when you first notified the Fit Note. It's one or the other. Taking the period from when you notified the Fit Note is, in my opinion, correct despite what your Work Coach said.

    Hi @MarkN88

@Cher_Scope yeah brilliant. Just seems like a topic that is misunderstood by both claimants and the DWP sometimes.

@calcotti Hi I have gone through there messages they previously sent.  And that it's based on the *date the based the decision on*, and taken into account when the fitnote was up dated.

@janer1967 Hello they not responded to my last reply, in regard as to why I was got confused etc. but rereading the messages they have based the 3 month wait on the date they made the decision on, hence why the waiting period will be April to May etc.

    Which is very unclear!
It should be based on when you first provided evidence of your health issues.
What is your UC payment date and what date did you first provide details of a Fit Note on?
