Hi all - Im currently in receipt of ESA and am in the support group
Im currently on LTA from my company and unfortunately taken my company to an employment tribunal of which the case is not until next year - im still getting sick pay but its due to end next April - I was bullied by some managers and the company partially upheld my grievance - the question is can I continue to claim ESA if I choose to leave the business - there is an insurance payment 2/3rds of weekly salary from my pension if its deems that I have to leave on health grounds - depression and anxiety

Leaving employment makes no difference yo your ESA claim. However if, after leaving employment, you get a health insurance payment for which you did not pay at least 50% of the premiums yourself then any contribution based ESA will be reduced by 50% of anything over £85/week. The income will be taken fully into account for any income based ESA.1
