Hii im doing a appeal for my boyfriend
put in a change of circumstances got denied without medical in the mandorty reconsideration said wasnt enough medical evidence to support what i was challengeing i sent over 100 pages and 25 of those supported to the points were scored 0 or low he score 6 in care 12 mobility which is already on and has been for 3 years .
so for appeal i highlighted the parts were supports what we was saying from his speicalist with extra real life day to day to say why these are a problem for him and needs help . They also used his first assement from 3 years ago to make up part of descion on MR which dont think was fair as alot has change in 3 years or i wouldnt have put the change off circumstances in
but to my main point it stated in the MR tried to phone 3 times asking do i have any more evidence which i did have i didnt at the time of the MR as had to request from out of area hospital . but we have had no missed calls at all so i rang up to request a call back for explanation of this . No one called so i rang them a week later turns out they not done this proper so i would never have got call if not contacted again . But they have correct phone number i double checked n i asked them to checked logs no call was made to us on the date they stated and time on the notes. Which was 5.53 so clocking off time hmmm .

Will this go in my favour on my appeal ?
They did check it as i was put it in my appeal statement about this and i would have access to the search anyways in my pack . Once we got to that stage just been threw this with uc and they reversed there descion before the tribunal was even set luckly .

Missed phone calls, for whatever reason, will make no difference to the appeal. The appeal is not about the claim process. It is about determining entitlement to PIP based on the evidence made available to the tribunal (including the claimant's testimony at the hearing).0

Wasnt a missed phone call the pip descion maker lied about trying to phone us she never did but said in the MR teiedr to contact 3 times to see if any more evidence
i no that but proves blatent lieing
but also said no evidence to support what i had wrote when there was literally from a expert who wrote a letter for us to state the difficulties he has doing cooking using microwave safely he got a buen that covers 50% thigh and part of his stomach using microwave and to stop cooking entirely but says can use microwave safely was under burns hospital for 8 week and permantely scarred for life said he has no problems managing medication and treatements etc but 25 out of the 100 documents i sent state he had severe short term memory problems and that either me or his mum are in contatct with his team and speak at every appointment even his speicalist nurse stated his mother and girlfriend have to remind ryan to take medications and anything he need to do becuase of his memory issues

It doesn't matter what has been said by whom up to this point. The appeal looks at every afresh. Tribunals know that the assessment reports are often very poor. For the appeal you need to be focused on explaining to the tribunal why an award of PIP is appropriate given the difficulties experienced carrying out the specified activities to the required standard.0

I have done that real life examples in the actual form in r MR and the appeal which im confused about which the evidence backs everything i wrote he had paper based assesment . For change of circumstances .
i had same problem with uc tbh i no diffrent scoring system and diffrent benifit but trying to ge them to understand on paper is hard work . Iv done 3 essays on ryans way off life his day to day what points i dont agree with and why with examples even said he doesnt use aids when he has epilepsy pillows camera underbed alarm system as advised by his team because of risk of death when he sleeps alone he has a very servere form of epilepsy as wel as other problems caused by this .
the descion maker even said i have to be neutral and cant override the MR but this is why have choice to take to appeal
but i see what you have said and noted it down and make sure u put these reason in appeal including the phone call they said you had so i was just asking as that is part of her descion and that descion and was proven to be lies what will tribunal say about it if anyone else had been threw something like that .
im on pip myself as i had bad accident 3 years ago n my assessor said certain stuff i didnt say i could do but luckly i didnt have do a MR the descion maker rang me before made descion rang me n said i dont agree with the assessor report the medical evidence says other wise so think its depends who you get on day sometimes .0 -
Concentrating on the "lies" in the report and in the decision letter will not get a PIP award. It could actually damage your case. Sending 100 documents of evidence is far too much in my opinion. Less is very often more.The best person to know exactly how your conditions affect you is yourself. A medical professional doesn't spend any time with you to know exactly how you're affected. They don't see you do any of the 12 PIP activities. The only way they would know is if you told them.If you haven't done so already then you need to give a couple of real world incidents of exactly what happened the last time the activity was attempted. With detailed information such as where you were, what exactly happened, did anyone see it and what the consequences were.I'd advise you to have a read of this link and to please take note of Mike's comments through out.It's also never too late to get expert advice and representation. They all support diffrent sections off the system
cooking
washing
out and about
medication
aids
toilet needs
which i did give real life examples from day to day life aswell .He has over 400 in last 2 years but picked out the parts what supported what i was saying and only sent two copy diffrent instances of same thing example burned twice ( now doesnt cook at all )
2 times found on pavement by ambulance police ( now cant be left alone ) happend more that this
me n his mother handleing his medication
all his medication changes letters ( uncontrolled )
phycosis due to sezuires n danger to self hospitalised 3 times in last year escaped .
doctors stating he might end up residental care
all these are in there paramdeic notes etc how he is postical
burn hospital he had quiet a few sezuires when we went for treatment while on bed
And in the notes about his postical state as they struggled to control him after .Memory problems his comsultant stating about it in letter to doctors to speak to his mother and do not pass information onto him about medication changes and appointments .
if i hadnt have sent any in would have got same descion as they said that wasnt enough evidence with all that
im not focusing on lies at all im annoyed yes and will mention it . Aswell as usuing a 3 year old assement to finalise there descion .
im focusing on the 3 parts were scored him zero when he should have a least 2 points

Pip rang me today they had till 8th to reply to appeal but was running behind the award has been changed and he been awarded standard daily living before needing progress with the appeal which is what i thought he was entitled to and the points i thought he was entiteled to have been given . No more stress now all done .
