Hi everyone I have been signed off sick for the past 9 months due to numerous health issues the main one being restless leg syndrome, I am under a specialist clinic in London, my condition has not changed if anything its getting worse to add to my stress my doc signed me off this time until Feb 23 as until I have my sleep clinic appointment in Jan 23 there will be no changes . I sent my last sick note in Aug and  dwp have refused to accept it ,when I submitted it the dwp said they would send me a letter for the work commitments assessment, I have asked why they are refusing this note no reply to date. I don't understand why they are refusing my condition is ongoing and unlikely to change. Can they just refuse to accept my docs sick note

Have you ever been found fit for work when claiming UC? This would be one reason why a fit note can be refused.
I would appreciate it if members wouldn't tag me please. I have all notifcations turned off and wouldn't want a member thinking i'm being rude by not replying.
If i see a question that i know the answer to i will try my best to help.

I was only fit for work when i actually signed into u.c then I had heart issues and doc signed me off and been off sick since then with various ailments but I've not had a work capability assessment.

You said you sent it in Aug but we are now towards the end of November, have you asked then why they haven't accepted it?
Have you been referred for the work capability assessment and received a form to fill in and return?

They should be accepting the Fit Note, indeed you are required to provide continuous Fit Notes once you have reported your health condition, until they have made a decision on your Work Capability Assessment. They should have referred you for the Work Capability Assessment 29 days after you reported the health condition with details of a Fit Note.

Your narrative is unclear. Is this correct?
You reported a health condition in August and reported details of a Fit Note in August. That was refused.
You have recently submitted details of a new Fit Note but haven't had a response to that.
You have not received a Work Capability questionnaire.

What exactly did they say in response to the health information you provided in August?
Information I post is for England unless otherwise stated. Rules may be different in other parts of UK.

If you sent it 2 weeks ago and its dated and due for Aug that could be why its not accepted

Does it always have the same medical condition written on it or has this changed

I originally submitted in Aug but had not realised it had not been accepted so was told I had not submitted it but when I went for interview was told to re submit which I did two weeks ago and found out that it was not accepted again and yes it was for the same condition only difference doc stated on note that I was under the sleep clinic

Doc signed me off until Feb as nothing would change until I had been assessed by the sleep clinic. I'm sorry if I'm not clear but lack of sleep means I don't always make sense as brain so exhausted

I was told I would get work capacity form in post but nothing I just don't understand why when all other notes have been accepted. I have asked then twice to give me a reason why it was refused but no reply it's like they read my messages reply to tell me to go to appointments but side step answering my question of why it's been refused and sorry if I'm making this hard work for you to follow, but being deprived of sleep is making it hard for me to explain

Before you receive the UC50 form you need to be referred for the WCA. Without the referral they can't send you the form. Once a referral is made you will receive the letter on your journal. Put a message onto your journal and ask to be referred.
You can also ask why your fit note hasn't been accepted.

Hi all I've just received this from dwp    your fit note was rejected as you have a current w.c.a. on the claim  decision details  capable for work  start date 29 Nov 2019  end date  current.there is no mandatory reconsideration or appeal on the claim and you have nor reported a new or deteriorated health condition.   1. I've never had a w.c.a form let alone an assessment  2. Does this mean that I have been capable for work since 2019  3 how  could I have reported these things if I was unaware that a claim had even been made and to the best of my knowledge I have not completed a wca assessment  form.

Were you claiming ESA at any point before claiming UC? If not and this is from your UC then you can have a look through your journal to see exactly if there’s a decision letter on your claim.

I don't think I was claiming esa. I have looked through my journal and it said I had a wca at the job centre which I was unable to attend as I was at hospital that day and as far as I can see this was not rescheduled

I’m not aware of them doing WCA at a job centre. You can be found fit for work for failing to attend.

I thought you had to fill a form out before you had a wca assessment which I have never received and why would my work coach be able to do this assessment

A WCA is not completed by a work coach.
