Question about appeal

victoria105victoria105 Member Posts: 22 Listener
Hi, I just have a question about the appeal , can pip be overturned if I sent new evidence with my appeal before the tribunal by dwp.
I was originally awarded pip till 2020 for severe hypermobility and many surgeries. I have a stroke and a bleed in Oct informed pip who sent an assessor ,then I lost all my pip.i wrote for a reconsideration and turned down but a lot of what the assessor said wasn't true. By then I had seen my consultant and got a letter from him and a letter supporting me from my GP. So I have sent all my new evidence to the appeal . So my question is when the appeal sends a copy to dwp could they decide I have enough evidence now without going to the appeal. Sorry if it doesn't make sense

    Hello Victoria

I am really sorry to read about what you are going through.

When an appeal case is lodged with the Tribunal Service, any evidence that is sent to them should then be sent to all parties.

So, if you have sent this additional evidence to the Tribunal Service they will send it to PIP.  You will know that this has happened as (confusingly) the Tribunal Service will post evidence to each and every party.  Thus, you and PIP should get a copy of the information you have sent.

When PIP are preparing the appeal papers they will look again at the decision they have made.  This means that they can change their decision without having to go to an appeal.  This situation is rare but not impossible.

    Kind regards

    Maria
