Hi, I'm Seany72! Am I eligible to a refund due to not being awarded PIP when first moving from DLA?

Welcome to the community @Seany72 how can we help?Disability Gamechanger - 2019

Ty ami, I have read that people who tried transferring from dla to pip might be due a refund if they were turned down, how do I find out if I am eligible
-
Hi @Seany72 - & welcome to the community. I haven't heard of such a refund, &, as the criteria for DLA are different to PIP, sadly some of those who were on DLA don't qualify for PIP. Can you remember where you read this?
-
It's been on Google news, the people who was doing the assessments made a lot of mistakes apparently and the government have already awarded millions to people who was refused, I do claim pip now but when I was meant to go from dla to pip I was refused but claim now under different circumstances
-
Hi and welcome
Not heard of this either would be good to find out more

I thought of the changes in PIP law too @Luna51 - but Seany72 said it was about people moving from DLA to PIP. I'm sure we would have heard about it if this was happening, so perhaps something poorly reported.....won't be the first time!

Hi @Seany72 and welcome to our community,
Could you send us a link to the google news article you're referring to by any chance? This isn't ringing bells for me at the moment I'm afraid.
Also, just to let you know - I've tweaked the title of your post and moved it to our PIP, DLA and AA category to help others better spot itOnline Community Co-ordinator

Have searched for a story on this and drew a blank.2024 The year of the general election...the time for change is coming 💡

I tried too @woodbine - also couldn't find anything on Google news.

I have just received an email from benefits and work about it, if you try and Google the benefits and work newsletter or subscribe to it you will be able to read on there about it

Hi @Seany72
I had this email today too.
It is about the LEAP review and claimants missing out on the higher mobility rate of PIP.
Specifically for those who face physiological distress when faced with following and planning journeys.

Here is the link to that very newsletter available to read on the B&W website..

There is certainly some discussion about people who may have been affected, as in the MH case, where many people would have hopefully been reviewed by the DWP if now considering 'overwhelming psychological distress' considered in conjunction with the 'Planning & following a journey' descriptor. The DWP stated that they would only look at those cases where potentially getting more points would culminate in a person being awarded the standard rate for the mobility component, or it might increase a standard award to that of enhanced. However, this is just about PIP, & not the migration from DLA to PIP as originally mentioned, so I'm a bit lost off.Seany72 said:..... This isn't something new or recent, even the B&W article is 10 weeks old, and they as usual seem to have an agenda (or is that just me being a cynic ,i'm always concerned about online benefits advice sites that charge a fee for full access, when it's all avaliable for free here and elsewhere).
In fairness to the DWP they are conducting what seems to be a thorough check into this and as above its not really about the move from DLA to PIP but all about PIP and a change in the rules (a change for the better for a change)2024 The year of the general election...the time for change is coming 💡 -
Whilst freely admitting that a B & W's guide on PIP probably helped my PIP claim, this was made freely available by my condition's support group ....free subscription for 2 years. When I joined Scope, I found way more appropriate info, & agree with woodbine, why pay for advice when it's freely available? So I'm a cynic too.
