can somebody please advise my husband and I had to finally migrate to UC it’s a joint claim and we were getting EESA we both get pip also. When we went yesterday to prove our identity I was then told I have to attend a work commitment interview. But because I get the enhanced rate for mobility and daily for living I thought I would not have todo this it’s also saying in my journal that I need to

Provide a not fit for work note but I don’t no what todo my husband does not have this as he has a variety of health issues and Parkinson’s, my daughter claims carers for him. But I look after him aswell but obviously don’t get anything if I was to get the caring element would I still have to look for work they also said I might have to attend a medical for uc I really don’t

Who was the main claimant of the ESA claim? If it was your husband then you will be treated as a job seeker. A PIP award doesn’t automatically exclude you from this or qualify you for LCWRA.

As your daughter is claiming carers allowance for looking after your husband then you would not be able to claim carers element or carers allowance because you can’t both claim for looking after the same person.

You can report your health condition and provide a fit note within 7 days. This will then start the work capability assessment process of. However, if your husband already receives the LCWRA element then you will not be entitled to any extra money but you wouldn’t need to attend appointments or look for work.

Unfortunately PIP has no bearing on the UC test for LCW/LCWRA.

As your husband will have LCWRA in his name, you won't get any extra money even if you are found to have it as well.

In a couples claim, the maximum number of LCWRA elements payable is one.

As your daughter gets Carers Allowance for him, you cannot get Carers Element.

Two different people cannot get CA and CE when caring for the same person.

My husband was getting eesa before we moved onto uc so does this mean I won’t have to look for work bit confused as it said in our journal that only applies to me that I have a work assessment app nxt wk then it said in the todo bit I have to send fit note so I don’t no what todo

As it was in your husbands name, Poppy's advice is correct you will be treated as a job seeker so you need to go through the WCA process, although no money will be payable if you are found to have LCWRA it will remove you from work requirements.

even if we were getting it before on eesa this does not qualify me on uc is this correct , also o forgot to mention im supposed to be doing a open university course nxt month part time would I still have to look for work

ESA was completely different to UC. Now you’re claiming UC as it was your partner that was the main claimant you will need to report your health condition and provide a fit note. As we have already advised.

You can do part time study but you will need to speak to your work coach first.
