Hi, I'm Steve23! Does anyone have any advice about appealing through the Employment Appeal Tribunal?
I’m pleased to have found this forum, it seems like a great space and community for mutual support and help.
I’ve been through an employment tribunal, where my case was dismissed. Because I applied to the tribunal too late. My case is about disability discrimination and bullying in my former job at [Removed by moderator – defamatory content, please see community house rules.], by my store manager.
I am in the process of appealing the tribunal decision, through the Employment Appeal Tribunal, which I didn’t know existed until very recently.
The tribunal process has been very stressful, and really impacted on my mental health. I’ve had great support from family and friends, which has helped.

Hi @Steve23 and a warm welcome to our community, I'm glad you found us even if it is in these unfortunate circumstances.
It sounds like you have been through a challenging time with your ex employer. To advise, I've edited out the name of your former workplace to ensure defamation in this instance is avoided, however this is not intended to invalidate or dismiss your claims. We fully empathise with your situation.

You can only appeal to the Employment Appeal Tribunal (EAT) if you think the employment tribunal made a legal mistake. This is called ‘appealing on a point of law’. You can't appeal just to challenge a decision you're not happy with. This means it's quite rare for cases to be appealed.
If you want to appeal, you must have the full written reasons for the tribunal's judgment.
You must appeal within 42 days of the date the written reasons for the judgment were sent out. You can find out how to appeal on the EAT website.
If you asked for written reasons late, you should start your appeal within 42 days of the date the tribunal sent you the judgment. If you haven’t got the written reasons yet, explain why in your appeal.
If you asked for a reconsideration but the tribunal hasn’t yet made a decision, you should also appeal before the deadline for making an appeal. This is just in case the tribunal rejects your request for a reconsideration. If you need help with an appeal, you can find details of organisations that might be able to help you find a solicitor.
